Resolution 172: Not concentrating many notary offices in the same area in Vietnam

Recently, there has been a situation where notary offices are established without a basis in notarization needs; the relocation of notary public offices from districts to central districts, towns, and cities within provinces has led to unhealthy competition in Vietnam.

Therefore, with the goal of developing the notarial practice in a stable and sustainable manner, to facilitate individuals and organizations in accessing notary services, ensuring legal safety for parties participating in contracts, transactions, dispute prevention, and protection of the legitimate rights and interests of individuals and organizations; innovating notary activities to meet the socio-economic development requirements of Vietnam, and judicial reform, integrating Vietnam's notary activities with the region and the world. Resolution 172/NQ-CP has set out the following directions for the development of the notarial practice:

For notaries

Develop a team of qualified notaries in appropriate numbers to meet social needs, linking the exercise of the notary's professional rights with responsibility before the law and the requester of notarization.

For notarial practice organizations

  • Develop notarial practice organizations with controlled operations linked to residential areas, ensuring a timely and full response to the notaryization requirements of individuals and organizations;

 

  • Do not concentrate many notarial practice organizations in the same district;
  • Continue to innovate notary offices to ensure agility, rational structure, self-reliance capacity, effective operation, and maintaining a leading and decisive role in the notary service market to serve political tasks and state management;
  • Provide support measures for the establishment of notarial practice organizations in economically and socially difficult areas, especially in extremely difficult areas.

 

For individuals seeking notarization

Encourage individuals and organizations to carry out notarized contracts and transactions to ensure legal safety for parties participating in contracts and transactions, which contributes to reducing the workload of administrative agencies, downsizing, and state budget expenditure.

For the state

  • Enhance the effectiveness of state management of the notarial practice, ensuring the guiding and regulating role of the state in supporting the development of the notarial practice.

 

  • Attach the responsibility of state management agencies for notarization at the local level to controlling the development of notarial practice organizations.
  • Standardize notarization procedures along with enhancing the application of information technology in notary activities, moving towards notarizing contracts and transactions in the electronic environment.
  • Enhance the coordination responsibility of ministries and sectors with the Ministry of Justice in organizing and conducting notary activities, especially in sharing information and interconnecting administrative procedures.
  • Fight against crime, prevent the use of notarization to legalize illegal transactions.
  • Promote the self-management responsibility of social organizations - the profession of notaries, especially in combating negative behaviors and violations of the law in notarial professional activities.

In addition to the direction for the development of the notarial practice, Resolution 172/NQ-CP also sets out the main tasks and solutions to implement the goals and directions of the notarial practice, including:

First, improve mechanisms, policies, and laws to create conditions for the stable and sustainable development of notary activities.

Second, promote the application of information technology in notary activities, meeting the requirements of building an e-government and the fourth industrial revolution.

Third, develop notarial practice organizations to ensure stability and sustainability linked to socio-economic development according to district level.

Fourth, enhance the effectiveness of state management of notarial practice organizations and activities and promote the role of social organizations - the profession of notaries.
