Regime and Policies for Rescue and Firefighting Rescuers

Decree 83/2017/ND-CP stipulates policies for individuals involved in fire prevention, firefighting, and rescue operations (including participants, mobilized individuals, and on-duty personnel) as follows:

For participants in rescue and emergency response; officers, team members of civil defense teams; firefighting and specialized firefighting teams participating in rescue and emergency response:

Individuals mobilized for rescue and emergency response, officers, team members of civil defense teams, firefighting and specialized firefighting teams participating in rescue and emergency response activities are entitled to the same policies as those participating in firefighting activities as stipulated in Decree 79/2014/ND-CP. Specifically:

- If firefighting time is less than 02 hours: Entitled to a compensation equal to 0.5 days statutory pay rate;- If firefighting time is between 02 hours and under 04 hours: Entitled to a compensation equal to 0.75 days statutory pay rate;- If firefighting time is 04 hours or more, or fighting fire over multiple days: Entitled to a compensation equal to 01 day statutory pay rate for every 04 hours. If participating in nighttime firefighting from 22:00 to 06:00, the rate is doubled.

In case of accident or injury:

- Medical examination and treatment expenses are covered;- If an accident reduces labor capacity: A subsidy is granted depending on the level of impairment;- If death occurs, funeral expenses and allowances are provided;- If injury falls under the provisions of the Ordinance on Preferential Treatment for People with Meritorious Service to the Revolution, entitlement to war invalids' benefits or similar policies is considered;- If death falls under the provisions of the Ordinance on Preferential Treatment for People with Meritorious Service to the Revolution, recognition as a martyr is considered.

Special provisions:

- Non-specialized firefighting team leaders and deputy leaders, aside from receiving full salary and other allowances (if any), also receive regular support from the managing agency or organization at a rate for each position, which cannot be less than 0.3 times the statutory pay rate;- Officers and civil defense team members participating in firefighting training and retraining are entitled to an allowance equal to 1.5 days statutory pay rate for each day of participation;- Officers and members of the basic and specialized firefighting teams, during training and retraining periods, are entitled to leave work, receive full salary and other allowances (if any), and an additional allowance equal to 0.5 days' pay for each day of training.

For officers, non-commissioned officers, soldiers, cadets, and public security workers in the Fire Prevention and Fighting Police force and rescue and emergency response:

Officers, non-commissioned officers, soldiers, cadets, and public security workers in the Fire Prevention and Fighting Police force and rescue and emergency response, in addition to the policies applicable to officers, non-commissioned officers, soldiers of the People's Police, also receive:

- Higher dietary regimes, additional nourishment when training, engaging in rescue and emergency response;- Benefits and policies as applied to individuals in heavy, hazardous, dangerous, and especially heavy, dangerous, and hazardous jobs as per the law.

For individuals on duty for rescue and emergency response:

Individuals on rescue and emergency response duty are entitled to overnight duty policies (starting from 22:00) as per Item 1, Article 18 of Decree 30/2017/ND-CP. Specifically:

- Level 1: On-duty for 04 hours or more per day is entitled to an additional meal allowance equal to 4% of the statutory pay rate as per current regulations;- Level 2: On-duty between 02 hours and under 04 hours is entitled to an additional meal allowance equal to 2% of the statutory pay rate as per current regulations.

For individuals mobilized for rescue and emergency response tasks

Individuals not receiving salary from the State Budget during the mobilization for rescue and emergency response tasks as per the decision of the competent authority are entitled to policies under point a and b, clause 1, Article 19 of Decree 30/2017/ND-CP. Specifically:

- Entitled to labor compensation for each industry as prescribed by the Provincial People's Committee:- For unskilled labor, the lowest labor compensation is 0.1 times the statutory pay rate;- For labor directly related to radioactive substances, biological agents, and hazardous chemicals, the lowest compensation is 0.1 times the statutory pay rate;- If the task is performed from 22:00 the previous day to 06:00 the following morning, the rate is doubled;- Performing tasks under hazardous conditions is entitled to on-site compensation as per legal regulations;- When performing tasks far from the place of residence and unable to commute daily, accommodation and food allowances are provided by the mobilizing agency, along with transportation support or one-time return travel expenses; meals are supported as per provincial regulations;

Individuals receiving salary from the State Budget, during the mobilization for rescue and emergency response tasks as per the decision of the competent authority, are entitled to full salary and allowances from their workplace, reimbursement for travel and per diem, and hazardous and area allowances as per current policies.

Public Security Officers and Soldiers mobilized for rescue and emergency response tasks as per the decision of the competent authority, are entitled to the same policies as individuals mobilized for rescue and emergency response tasks who do not receive salary from the State Budget.

For those participating in rescue and emergency response suffering illness, injury, or death:

The regime and policies for those suffering illness, injury, or death are implemented as stipulated in clause 2, Article 20 of Decree 30/2017/ND-CP. Specifically:

- For individuals participating in mandatory social insurance who fall ill, get injured, or die, are entitled to policies as per social insurance regulations, occupational health and safety law, and health insurance law;- For individuals not participating in mandatory social insurance:- In case of illness: When performing tasks, if not participating in health insurance, medical examination and treatment expenses as per health insurance standards are covered;- In case of injury:- Medical expenses during first aid, emergency treatment until stabilization of injuries are covered;- After treatment, the competent authority introduces them for a labor capacity assessment by the Medical Assessment Council;- If the individual not participating in social insurance suffers a 5% reduction in labor capacity, they are entitled to 05 times the statutory pay rate, with an additional 0.5 times for each additional percentage of reduction;- Individuals injured and losing one or more body parts or functions, presenting various disabilities, reducing activity capacity, hampering labor, daily activities, and studies, are entitled to preferential policies as per the law for individuals with disabilities;- In case of death, including death during the initial treatment period, if the deceased has not participated in social insurance, the person directly handling the funeral receives 10 times the statutory pay rate, and the family receives a lump-sum allowance of 36 times the statutory pay rate.

For individuals injured or killed while performing rescue tasks

Individuals participating in rescue operations to save state and public assets, if injured or killed, are considered for preferential treatment policies according to current legal provisions.
