Procedures for appointment of orensic psychiatric assessors in Vietnam are guided in Decision 3147/QD-BYT in 2022, specifically as follows:
1. Procedures for appointment of central-level forensic psychiatric assessors in Vietnam
* Application for appointment of forensic psychiatrist
- A written request for appointment of a forensic psychiatric expert from a competent agency or organization and a list of excerpts made according to the form specified in Appendix 1 issued together with Circular 11/2022/TT-BYT.
- Certified copies of diplomas and certificates according to the criteria for appointment of forensic psychiatrists specified in Clause 1, Article 3 of Circular 11/2022/TT-BYT.
Diplomas issued by foreign educational institutions must be recognized for use in Vietnam in accordance with an agreement on degree equivalence or mutual recognition of qualifications or according to international treaties related to diplomas to which the Socialist Republic of Vietnam has signed.
- A curriculum vitae according to the form specified in Appendix 2 issued together with Circular 11/2022/TT-BYT, with a 4cm X 6cm color portrait photo attached no later than 06 months before the time of application submission, affixed with a border seal, and certified by a competent state agency (original).
- Certificate of actual time of professional activities in the field of training or Certificate of time directly assisting in assessment activities at a forensic examination organization consistent with the professional qualifications in the field of training of the agency or organization where the person proposed to work is made according to the form specified in Appendix 3 issued together with Circular 11/2022/TT-BYT.
- A copy of the certificate of professional training as prescribed in Clause 2, Article 3 of Circular 11/2022/TT-BYT.
- Two color portrait photos of size 2cm X 3cm taken no more than 6 months before the application deadline (for the assessment of the assessor's card).
* Order of appointment of forensic psychiatrist
- Step 1: The Ministry of National Defense, the Ministry of Public Security, the National Institute of Forensic Medicine, the Central Institute of Forensic Psychiatry, and the Regional Center for Forensic Psychiatry under the Ministry consider, select, and complete the application to summarize and send to the Ministry of Health.
- Step 2: The Personnel and Organization Department, the Ministry of Health, shall assume the prime responsibility for, and coordinate with the Medical Examination and Treatment Administration and the Legal Department in reviewing the application for appointment of a forensic psychiatrist.
Within 20 days from the date of receipt of a complete and valid dossier, the Department of Organization and Personnel shall submit it to the Minister of Health for consideration and a decision on the appointment of a forensic expert in accordance with the law. In cases of ineligibility for appointment, the Ministry of Health shall notify the agency or unit requesting the appointment in writing, clearly stating the reason.
- Step 3: Return the result:
+ Decision of the Minister of Health on the appointment of forensic psychiatric experts.
+ A document of the Ministry of Health to the agency requesting the appointment of an assessor, notifying the reason for not appointing (in case of ineligibility for appointment).
2. Procedures for the appointment of provincial-level forensic psychiatric assessors in Vietnam
* Application for appointment of forensic psychiatrist
- A written request for appointment of a forensic expert from a competent agency or organization and a list of horizontal extracts made according to the form specified in Appendix 1 issued together with Circular 11/2022/TT-BYT.
- Certified copies of diplomas and certificates according to the criteria for appointment of forensic psychiatrists specified in Clause 1, Article 3 of Circular 11/2022/TT-BYT.
Diplomas issued by foreign educational institutions must be recognized for use in Vietnam in accordance with an agreement on degree equivalence or mutual recognition of qualifications or according to international treaties related to diplomas to which the Socialist Republic of Vietnam has signed.

* Order of appointment of a forensic psychiatrist
- Step 1: Provincial police, provincial forensic center, and medical facilities under the management of the Department of Health select people who fully meet the criteria specified in Article 3 of Circular 11/2022/TT-BYT, guide individuals to complete dossiers of appointment of forensic experts according to the provisions of Article 4 of Circular 11/2022/TT-BYT, and send them to the provincial Department of Health.
- Step 2: The Department of Health is responsible for receiving and checking the validity of the application. In case the dossier is incomplete, the Department of Health shall issue written instructions to the unit or individual to complete the dossier;
- Step 3: Within 20 days from the date of receipt of complete and valid dossiers, the Department of Health shall assume the prime responsibility for, and coordinate with the Department of Justice in, appraising the application for appointment of a forensic expert and submitting it to the President of the provincial People's Committee for consideration and decision on the appointment of a forensic expert.
In the event of a refusal to appoint, the Department of Health must reply in writing and clearly state the reason.
Decision 3147/QD-BYT takes effect as of December 15, 2022
