1. What are the obligation to join the People’s Public Security Force in Vietnam?
Article 8 of the Law on People's Public Security 2018 stipulates the obligation to join the People's Police as follows:
- A citizen’s fulfillment of the obligation to join the People’s Public Security Force means that he/she has performed their obligation to defend the Fatherland during his/her service in the people’s armed force. Annually, the People’s Public Security Force may recruit citizens within age for service into the People’s Public Security Force for a period of 24 months.
- The Minister of Public Security shall be accorded authority to extend the period of service of non-commissioned officers and conscripts to no more than 06 months in the following cases:
+ Extension of the period of service serves the purpose of being ready to fight;
+ Extension of the period of service may be granted if they are performing natural disaster or epidemic prevention and control or rescue tasks.
2. Recruitment of citizens into the People’s Public Security Force in Vietnam
Article 7 of the Law on People's Public Security 2018 regulates the selection of citizens to the People's Public Security as follows:
- Citizens who meet the political criteria, moral qualities, qualifications, health, age and aptitude suitable for public security work, have aspirations, and the People's Public Security Forces have needs can recruited into the People's Police.
- The People's Public Security Forces shall have priority in recruiting excellent students and graduates from higher education institutions and vocational education institutions that are qualified to train and supplement to the People's Police.
3. Application for selection to participate in public security service in Vietnam
Pursuant to Article 6 of the Decree 70/2019/ND-CP, the selection documents are as follows:
Citizens participating in the selection and fulfilling the obligation to join the People's Police shall submit the following papers to the police offices of communes, wards and townships (hereinafter referred to as commune-level police) where the citizen has permanent residence:
- A declaration of registration to perform the obligation to join the People's Police, made according to the form in the Appendix issued with this Decree, certified by the People's Committee of the commune, ward or township (commune-level People's Committee) of the place of residence or of agency or organization where that person is working or studying.
- Certificate of military service registration.
4. Selection procedures to join the public security service in Vietnam
Pursuant to Article 7 of the Decree 70/2019/ND-CP, the selection and calling of citizens to perform the obligation to join the People's Police shall follow the following steps:
Step 1: The commune-level police station, based on the number of citizens to fulfill the obligation to join the People's Police assigned in the commune:
- Advise the People's Committee of the same level to organize announcements and propaganda on the mass media and publicly post them at the headquarters of the Police and the People's Committees of communes on the subjects, criteria, conditions, and time for receiving them. enrollment application. The time limit for receiving recruitment application dossiers is at least 30 days from the date of notification;
- Receive the application of citizens applying for recruitment and organize the pre-qualification (height, weight, body shape); report the results (attached to the dossier) of the qualified cases through the pre-qualification to the district-level police station;
Step 2: The district-level police shall select and call citizens to fulfill the obligation to join the People's Police, as follows:
- The head of the district-level Police Department shall issue an order to call a citizen for a medical examination according to the provisions of Clause 2, Article 40 of the Law on People's Public Security 2018. The order for a medical examination must be delivered to the citizen fifteen days before the time of the medical examination;
- Organize background checks and draw political conclusions for those who meet health standards according to the conclusions of the district health examination council;
- Report to the Military Service Council and submit it to the Chairman of the district-level People's Committee for decision on the list of citizens selected to perform the obligation to join the People's Police;
- Based on the list of citizens selected to perform the obligation to join the People's Police approved by the Chairman of the district-level People's Committee, the district-level police chief shall issue an order to call each citizen to perform the obligation to join the People's Police.
5. Selected subjects to serve in the people's public security service in Vietnam
Pursuant to Clauses 1 and 2, Article 4 of Decree 70/2019/ND-CP stipulating the subjects selected to serve the people's police service are as follows:
- Male citizens of enlistment age have registered for military service in accordance with the Law on Military Service 2015. Female citizens of enlistment age have registered for military service in accordance with the Law on Military Service 2015. If they voluntarily and the People's Public Security have a need, they shall be considered and selected to perform the obligation to join the People's Police.
- The Minister of Public Security shall specify the age for recruitment of citizens to perform the obligation to join the People's Police in accordance with the nature and characteristics of each employing unit and stipulate the necessary professions for recruitment. female citizens shall perform the obligation to join the People's Police in accordance with the needs of each period.
6. Duration of the people's public security service in Vietnam
Pursuant to Clause 3, Article 4 of Decree 70/2019/ND-CP stipulating the time to serve the People's Police as follows:
The time limit for performing the obligation to join the People's Police is 24 months.
The Minister of Public Security shall decide to extend the duration of active duty service of non-commissioned officers and conscripts, but not exceeding 6 months in the cases specified in Clause 1, Article 8 of the Law on People's Public Security 2018
The time to perform the obligation is counted from the date of delivery of the citizen;
In case of no centralized delivery, it is counted from the date of receipt by the People's Public Security unit until it is decided to demobilize by the competent authority.
The time of desertion, the time of serving the prison sentence shall not be included in the time of performing the obligation to join the People's Police.
