Ministry of Health of Vietnam: Draft Circular guiding in detail places where smoking is completely prohibited

This is a notable content of the Draft Circular guiding the implementation of regulations on places where smoking is prohibited and the consideration and award of the title of smoke-free environment.

Specifically, pursuant to Article 7 of the Law on Tobacco Harm Prevention 2012 of Vietnam:

Article 7. Rights and obligations of citizens in the prevention of tobacco harms

1. To live and work in an environment without cigarette smoke.

2. To request smokers not to smoke at non-smoking places.

3. To encourage other people not to use tobacco or quit smoking.

4. To request competent agencies, organizations or persons to discipline people who smoke at non-smoking places.

5. To report competent agencies or persons that fail to discipline acts of smoking at non-smoking places.

According to Article 2 of the Draft Circular, applicable subjects of this Circular are as following:

Entirely non-smoking locations in the home and within the premises	Health facilities;
	Educational institutions, except for higher education institutions and vocational education institutions with classroom blocks with a volume of more than 5,000 m3;
	Care, nurturing, amusement and entertainment establishments exclusively for children;
	Facilities or areas with a high risk of fire or explosion
The place is completely smoke-free in the house	Working places of state administrative agencies, public non-business units, enterprises, political organizations, socio-political organizations, social organizations, socio-professional organizations and workplaces in another house
	Higher education institutions and vocational education institutions have classrooms with a volume of less than 5,000 m3;
	Train stations, piers, bus stations, convention centers, theatres, cultural houses, cinemas, circuses, clubs, sports halls, covered stadiums, restaurants, cafes cafes, food service establishments, entertainment service establishments and other public places
Public transport is completely banned from smoking	Cars;
	Airplanes;
	Electric train.
Smoking is prohibited in the house, but a designated smoking area is allowed	Airport isolation area;
	Bars, karaoke bars, discos;
	Hotels, motels, guest houses, resorts and other tourist accommodation establishments;
	The means of public transport are ships and trains.

Currently, administrative handlings for violations against regulations on non-smoking areas are prescribed in Article 25 of the Decree No. 117/2020/NĐ-CP, specifically as follows:

- A warning or a fine ranging from VND 200.000 to VND 500.000 shall be imposed for smoking in non-smoking areas. Acts of in-light smoking shall be penalized in accordance with regulations on penalties for administrative violations in civil aviation sector.

- A fine ranging from VND 3.000.000 to VND 5.000.000 shall be imposed for commission of one of the following violations:

+ Failing to display “non-smoking” words or signs at non-smoking areas as prescribed by law;

+ Failing to organize, instruct, inspect and expedite the implementation of smoking bans in areas under management.

- A fine ranging from VND 5.000.000 to VND 10.000.000 shall be imposed for commission of one of the following violations in designated smoking areas:

+ Failing to provide rooms and air ventilation systems separate from non-smoking areas;

+ Failing to provide containers of tobacco butts and ashes;

+ Failing to display signs at suitable and prominent positions;

+ Failing to provide firefighting equipment.
