Jurisdiction of the High People's Court in Vietnam

In Vietnam, there are currently 03 High People's Courts, namely the High People's Courts in Hanoi, Ho Chi Minh City and Da Nang. So what are regulations on the jurisdiction of the High People's Court?

1. Jurisdiction to adjudicate cases of the High People's Court in Vietnam

According to Article 29 of the Law on Organization of People's Courts 2014, the High People's Court's jurisdiction to adjudicate on a case-by-case basis in Vietnam is as follows:

- To conduct appellate trial of cases in which first-instance judgments or decisions of people’s courts of provinces or centrally run cities within their territorial jurisdiction which have not yet taken legal effect are appealed or protested against in accordance with the procedural law.

- To conduct trial according to cassation or reopening procedure of cases in which judgments or decisions of people’s courts of provinces, centrally run cities, rural districts, urban districts, towns, provincial cities or the equivalent within their territorial jurisdiction which have taken legal effect are protested against in accordance with the procedural law.

2. Territorial jurisdiction of the High People's Court

Article 1 of Resolution 957/NQ-UBTVQH13 stipulates the territorial jurisdiction of the High People's Court of Vietnam as follows:

- The High People's Court in Hanoi has territorial jurisdiction over 28 provinces and centrally-run cities, including: Hanoi city, Hai Phong city; provinces: Hoa Binh, Phu Tho, Tuyen Quang, Ha Giang, Thai Nguyen, Cao Bang, Bac Kan, Lao Cai, Yen Bai, Lang Son, Son La, Lai Chau, Dien Bien, Vinh Phuc, Hung Yen, Hai Duong , Bac Ninh, Bac Giang, Ha Nam, Quang Ninh, Thai Binh, Nam Dinh, Ninh Binh, Thanh Hoa, Nghe An and Ha Tinh.

- The High People's Court in Da Nang has territorial jurisdiction over 12 provinces and centrally-run cities, including: Da Nang city; provinces: Quang Binh, Quang Tri, Thua Thien - Hue, Quang Nam, Quang Ngai, Binh Dinh, Phu Yen, Khanh Hoa, Gia Lai, Kon Tum and Dak Lak.

- The High People's Court in Ho Chi Minh City has territorial jurisdiction over 23 provinces and centrally-run cities, including: Ho Chi Minh City, Can Tho city; provinces: Binh Thuan, Ninh Thuan, Dong Nai, Ba Ria - Vung Tau, Binh Duong, Binh Phuoc, Long An, Tay Ninh, Dak Nong, Lam Dong, Hau Giang, Dong Thap, Tien Giang, Ben Tre, Tra Vinh , Vinh Long, Soc Trang, Bac Lieu, Ca Mau, An Giang and Kien Giang.
