Increase fines for stopping and parking on highways from 2022

The Government has just issued Decree 123/2021/ND-CP amending and supplementing a number of articles of the Decrees on penalties for administrative violations in the maritime domain; road and railway traffic; domestic airline.

Accordingly, adding point d after point c, clause 7, Article 5 of Decree 100/2019/ND-CP stipulating penalties for administrative violations in the field of road traffic and railways as follows:

A fine ranging from VND 10,000,000 to VND 12,000,000 shall be imposed on vehicle drivers who commit the following acts:

Stopping, parking on the highway at the wrong place; there are no signals to let other drivers know when they are forced to stop or park on the highway at the wrong place; U-turn on the highway

(Currently, the fine for this act is from 6,000,000 VND to 8,000,000 VND).

In addition, a fine of between VND 10,000,000 and 12,000,000 shall be imposed on vehicle drivers who pick up and drop off passengers on highways. (Currently, the fine is from 5,000,000 VND to 7,000,000 VND).

Thus, from January 1, 2022, the act of stopping or parking on the highway at the wrong place will be heavily fined from 10,000,000 VND to 12,000,000 VND instead of 6,000,000 VND to 8,000 VND. .000 VND as before. At the same time, also increase the fine from 10,000,000 VND to 12,000,000 VND for the act of picking up and dropping off passengers on the highway.

In addition, from 2022, the fines for a number of administrative violations in the field of road traffic will also change, for example:

- A fine ranging from VND 6,000,000 to VND 8,000,000 shall be imposed on drivers who fail to yield to the right of way or obstruct the vehicle with the right-of-way which is sending priority signals to go on duty.

- A fine ranging from VND 800,000 to VND 1,000,000 shall be imposed on vehicle drivers who commit the following acts:

+ Make a U-turn at the place where the road intersects at the same level as the railway; making a U-turn at narrow roads, ramps or curves where visibility is obscured, where there is a signboard that prohibits turning for the type of vehicle being driven;

+ Operating a vehicle to make a left turn at a place where there are signs that prohibit left turns for the type of vehicle being driven; (Additional content)

+ Operating a vehicle to turn right at a place with a signboard stating that right turns are prohibited for the type of vehicle being driven. (Additional content)

- A fine ranging from VND 1,000,000 to VND 2,000,000 shall be imposed on vehicle drivers who commit the following acts:

Operating a vehicle that is not eligible to collect tolls in the electronic form automatically without stopping (vehicles do not have a terminal tag or a terminal tag but the amount in the toll account is not enough to pay when crossing the toll lane) automatic driver does not stop) enter the dedicated lane for toll collection automatically without stopping at toll booths.

(Compared to the current one, explain more clearly about vehicles that are not eligible for toll collection in the form of automatic non-stop electronic toll collection).

Decree 123/2021/ND-CP takes effect from January 1, 2022.
