On December 23, 2014, during its 33rd session, the Standing Committee of the XIII National Assembly passed the Ordinance on Environmental Police; on January 5, 2015, the President signed Order No. 01/2015/L-CTN promulgating the Ordinance on Environmental Police. The Ordinance on Environmental Police takes effect from June 5, 2015.
Ordinance on Environmental Police has been issued to address the limitations and inadequacies of previous legal documents regulating the prevention and fight against crimes and legal violations related to the environment, as well as regulations on functions, duties, authorities, organization, and conditions ensuring the operation of the Environmental Police and the responsibility of agencies and organizations in preventing and fighting against crimes and legal violations concerning the environment, resources, and food safety. It ensures synchronization in the State's legal system in preventing and fighting crimes and legal violations related to the environment, resources, and food safety.
Based on practical demand, preventing and fighting against crimes, legal violations related to the environment, resources, food safety, and the roles, functions of the Environmental Police, the Ordinance on Environmental Police stipulates in five chapters and 19 articles, including some basic duties and authorities of the Environmental Police, such as: Collecting information, analyzing, evaluating, forecasting the situation for advising and proposing to competent authorities for directing the work of preventing and fighting against crimes and legal violations related to the environment, resources, and food safety; applying police work measures to organize prevention and fight against crimes and legal violations; receiving, handling, and resolving reports and complaints about crimes and legal violations as per legal regulations.
Moreover, the Environmental Police conduct investigations on crimes related to the environment, resources, and food safety related to the environment under the law; carry out inspections on the compliance of laws by agencies, organizations, and individuals as per legal regulations...
Ordinance on Environmental Police stipulates principles regarding the organizational system of the Environmental Police, whereby the Environmental Police are arranged into three levels: Department under the Ministry of Public Security; Division under the Provincial Police; Team under the District-level Police, and equivalent administrative units; specifically regulating equipment, funding, policies, and policies for officials, officers of the Environmental Police and policies for agencies, organizations, individuals participating in, coordinating with, assisting the Environmental Police in performing their duties...
To ensure the implementation of the Ordinance on Environmental Police is conformable and takes root in life and practice, the Environmental Police force needs to advise and propose to competent authorities to direct and implement the following key tasks:
First, focus on drafting detailed regulatory documents, guiding the implementation of the Ordinance on Environmental Police, specifically: The Government's Decree detailing the implementation of several articles of the Ordinance on Environmental Police; Circular of the Minister of Public Security guiding the implementation of the Decree detailing the implementation of several articles of the Ordinance on Environmental Police.
Second, organize dissemination, intensive training on the Ordinance on Environmental Police and detailed regulatory documents, guiding the implementation for officials, officers of the People's Public Security, especially those directly performing tasks of preventing and fighting against crimes and legal violations related to the environment, resources, and food safety.
Third, cooperate with press agencies, broadcasting, and television, People's Public Security Magazine, and local police information websites to propagate, disseminate, introduce the content of the Ordinance on Environmental Police and detailed regulatory documents, guiding the implementation. Coordinate with People's Public Security schools to research and incorporate the content of the Ordinance on Environmental Police and detailed regulatory documents, guiding the implementation into teaching, training, and retraining programs for leadership, commanding officials, officers, and particularly students.
Fourth, consolidate the organization and ensure the conditions to implement the Ordinance on Environmental Police. Research and establish functions, duties, authorities, and advise the Ministry's leadership to consolidate the organization of the Environmental Police force according to the Ordinance on Environmental Police and the detailed guiding regulatory documents. Strengthen personnel with capabilities, professional qualifications, and ethical qualities for the Environmental Police.
Fifth, build the Project "Enhancing the Capacity for the Environmental Police Force, phase 2015-2021", prioritizing the investment in constructing office buildings, inspection and appraisal centers, equipping with modern means and technical devices, meeting the task requirements of preventing and fighting against crimes, legal violations against the environment, resources, and food safety.
