In Vietnam, Is it mandatory to do military service when married?

According to current Vietnamese regulations, there are many cases in which male citizens are exempt from military service. Therefore, in the case of married men, are they required to do military service?

The age of enlistment of Vietnamese citizens is now stipulated in Article 30 of the Law on Military Service 2015 of Vietnam, specifically, citizens who are full 18 years old are called to join the army; The age for enlistment is from full 18 years old to the end of 25 years old; Citizens who have been trained at the college or university and have been temporarily suspended for enlistment will have the age to call for military service until the end of 27 years. The age of the citizen is calculated according to the day, month and year on the birth certificate until the date of going to military service

Pursuant to Clause 1, Article 41 of the 2015 Law on Military Service of Vietnam, the following male citizens are entitled to t Postponement and exemption from conscription, including:

- Not healthy enough to serve in the army according to the conclusion of the Health Examination Council of Vietnam

- Being the only employee who has to directly take care of relatives who are no longer able to work or have not yet reached working age; family members suffering the heavy loss of life and property due to accidents, natural disasters or dangerous epidemics, certified by the People's Committees of communes, wards and townships (hereinafter referred to as commune level).

- Any citizen who is a child of sick soldiers, people infected with dioxin and suffering labor capacity reduction from 61% to 80%.

- Having a brother, sister or younger brother who is a non-commissioned officer or soldier currently serving in the army; non-commissioned officers and soldiers performing the obligation to join the People's Police.

- Persons who are subject to emigration or relocation in the first 3 years to communes with special difficulties under the State's socio-economic development projects decided by the People's Committees of provinces or higher.

- Officials, public employees and youth volunteers may be assigned to work or work in areas with extremely difficult socio-economic conditions as prescribed by law.

- Studying at a general education institution; are being trained at the university level of the regular system of the higher education institution, the college level of the regular system of the vocational education institution during a training course of a training degree.

At the same time, in Clause 2, Article 41 of the 2015 Law on Military Service of Vietnam, the following citizens are exempt from conscription:

- C Any citizen who is a child of revolutionary martyrs or grade 1 wounded soldiers;

- Any citizen who is a brother of revolutionary martyrs;

-  Any citizen who is a child of grade 2 wounded soldiers; a child of sick soldiers suffering labor capacity reduction of 81% or above; a child of people infected with dioxin and suffering labor capacity reduction of 81% or above;

- Any citizen carrying out essential tasks who is not a soldier or a People’s Army;

-  Any citizen who is official or youth volunteer assigned to extremely disadvantaged socio-economic area according to the law provisions for 24 months or more

Therefore, marriage is not one of the cases where military service is postponed or exempted. Therefore, even though married citizens who are still of the age for enlistment, they are still required to participate in military service according to the Vietnamese provisions of law.
