Implementation and assessment of environmental protection

Development of environmental protection in Vietnam

02/2022/TT-BTNMT provides for environmental protection in Vietnam as follows:

- District-level People's Committees shall prepare environmental protection in Vietnam reports by using the form No.

- Management boards of economic zones, processing and exporting zones, hi-tech zones and industrial parks must prepare reports on environmental protection as prescribed in Form No.

- Provincial-level People's Committees shall direct provincial-level Departments of Natural Resources and Environment to assume the prime responsibility for, and coordinate with related departments and sectors in, preparing environmental protection in Vietnam reports according to form No.

- Ministries, ministerial-level agencies shall prepare the report on the implementation of environmental protection tasks according to the Form No.

- The Ministry of Natural Resources and Environment shall compile an environmental protection report and submit it to the Government, which will submit it to the National Assembly in the following order:

+ Prepare drafts of reports on environmental protection nationwide by assessing and summarizing results of environmental protection in Vietnam activities of ministries, ministerial-level agencies and provincial-level People's Committees;

+ Organizing collection of suggestions from ministries, ministerial-level agencies and provincial People's Committees on the draft report on environmental protection in Vietnam across the country;

+ Study, assimilate, explain opinions, complete the draft report and submit it to the Government for reporting to the National Assembly as prescribed.

EVALUATION OF ENVIRONMENTAL PROTECTION RESULTS

02/2022/TT-BTNMT prescribing the evaluation of environmental protection results as follows:

- Based on the assigned tasks of environmental protection in Vietnam, the ministries and ministerial-level agencies shall carry out self-assessment of result of implementation of environmental protection and formulate report on implementation of their tasks of environmental protection and send it to the Ministry of Natural Resources and Environment before February 15 annually for summing up and submitting to the Government for reporting to the National Assembly.

- Environmental protection outcomes by the People's Committees of provinces shall be assessed as follows:

+ Based on environmental protection requirements and state management tasks over environmental protection in each period, the Ministry of Natural Resources and Environment shall issue the set of indicators and documents guiding the evaluation of environmental protection performance by the provincial People's Committee;

+ The Provincial-level People's Committee shall carry out the self-assessment of environmental protection results according to the set of indicators and documents providing guidance on assessment of environmental protection results, and take responsibility for the accuracy and sufficiency of information, data and self-assessment in Vietnam results;

+ The Ministry of Natural Resources and Environment shall invite a socio-political organization or a sociological survey organization to assess the satisfaction of people with the quality of the living environment in provinces and centrally run cities. Results of investigation used for assessment in Vietnam of environmental protection task;

+ The Ministry of Natural Resources and Environment establishes the council on environmental protection assessment of the Provincial-level People's Committee. Components of the council include representatives of Ministries, ministerial agencies, organizations, experts and scientists concerned;

+ Based on the assessment results of the council, the Ministry of Natural Resources and Environment shall summarize, approve and publicize results of environmental protection assessment in Vietnam conducted by the provincial-level People's Committee.
