Hai Duong, Vietnam: Fine of up to 3 million VND for not carrying out COVID-19 test as required

This is the remarkable content specified in Official Dispatch 107/STP-XDKT&TDTHPL on the handling of violations of the law in the prevention and control of the Covid-19 epidemic, issued by the Department of Justice of Hai Duong province on January 29, 2021.

Vietnam's Directive 15/CT-TTg; Directive 16/CT-TTg; Directive 05/CT-TTg of the Prime Minister on some urgent measures to prevent and control the COVID-19 epidemic and Vietnam's Official Dispatch 01/CD-UBND dated January 28, 2021 of the Provincial People's Committee on the implementation of measures for urgent prevention and control of the COVID-19 epidemic in Hai Duong province shall be implemented. Based on the actual situation, in order to strictly implement the provisions of the law to reduce the risk of community transmission, the Hai Duong Department of Justice issued Vietnam's Official Dispatch 107/STP-XDKT&TDTHPL guiding the handling. Some violations of the law in the prevention and control of the COVID-19 epidemic are as follows:

(1) A fine ranging from VND 1,000,000 to VND 3,000,000 shall be imposed if testing is not carried out at the request of a competent health authority during the course of Covid-19 disease surveillance.

(Regulation: at Point a, Clause 2, Article 7 of Decree 117/2020/ND-CP)

Sanctioning competence: Chairman of the commune-level People's Committee; Chief Health Inspector; Chief of district-level Public Security, Head of provincial-level Public Security Bureau.

(2) A fine ranging from VND 10,000,000 to VND 20,000,000 shall be imposed for concealing, failing to declare or failing to promptly declare the status of oneself or another person suffering from the Covid-19 epidemic.

Sanctioning competence: Chairman of district-level People's Committee; Chief Inspector of Department of Health; Director of Provincial Police.

At the same time, the case of spreading the COVID-19 epidemic to others will be handled according to Article 240 of the Criminal Code 2015.

(3) A fine ranging from VND 15,000,000 to VND 20,000,000 shall be imposed for refusing or evading the application of decisions on medical isolation or coercive medical isolation issued by competent state agencies to the infected person. Covid-19. In addition, the remedial measure "Forced medical isolation, coercive medical isolation" must be applied.

At the same time, the case of spreading the COVID-19 epidemic to others will be handled according to Article 240 of the Criminal Code 2015.

(4) A fine ranging from VND 1,000,000 to VND 3,000,000 shall be imposed if it is not necessary to wear a mask in public or go out on the street.

Sanctioning competence: Chairman of the commune-level People's Committee; Chief Inspector of Department of Health; Chief of district-level Public Security, Head of provincial-level Public Security Bureau.

(5) A fine ranging from VND 10,000,000 to VND 20,000,000 for individuals (from VND 20,000,000 to VND 40,000,000 for organizations) if the decision to apply the measure of temporarily suspending the operation of a public food service establishment that is at risk of spreading the Covid-19 epidemic is not implemented.

(6) A fine of from VND 10,000,000 to VND 20,000,000 for individuals (from VND 20,000,000 to VND 40,000,000 for organizations)  if it fails to implement the decision to apply measures to limit mass gatherings or temporarily suspend business and service activities in public places to prevent and control the Covid-19 epidemic.

(Regulation: at Point c, Clause 3, Article 12 of Decree 117/2020/ND-CP)

Sanctioning competence: Chairman of district-level People's Committee; Chief Inspector of Department of Health; Director of Provincial Police.

At the same time, in the case of business owners, managers of service businesses (such as bars, karaoke, massage services, beauty salons, gym/yoga, cinemas) conducting business activities when there is a decision to temporarily suspend business activities to prevent and control the COVID-19 epidemic, causing a loss of VND 100,000,000 or more due to incurring expenses for disease prevention and control, they will be handled according to Article 295 of the Criminal Code 2015.

(7) A fine ranging from VND 30,000,000 to VND 40,000,000 shall be imposed on individuals (from VND 60,000,000 to VND 80,000,000 for organizations) who fail to comply with the decision to ban mass gatherings in areas that are in the state of emergency for the Covid-19 epidemic.

Sanctioning authority: Chairman of the Provincial People's Committee.

Thus, it can be seen that, in the face of a very complicated epidemic situation in Hai Duong, the Hai Duong Department of Justice has strengthened inspection and strictly handled a number of law violations in the prevention and control of epidemics.
