The Law on Biodiversity of Vietnam consists of 8 Chapters, 78 Articles. Main contents of chapters are as follows:
Chapter I: General provisions consist of 7 articles: governing scope, subjects of application, interpretation of terms, principles, State policies on the conservation and sustainable development of biodiversity, Slate management responsibilities for biodiversity and prohibited acts.
Chapter II: Biodiversity conservation planning consists of 8 articles: bases for the formulation of a national master plan on biodiversity conservation; contents of a national master plan on biodiversity conservation; formulation, approval and adjustment of a national master plan on biodiversity conservation, and biodiversity conservation plannings of ministries and ministerial-level agencies; publicization and organization of implementation of a national master plan on biodiversity conservation; bases for the formulation of biodiversity conservation plannings of provinces and centrally run cities; contents of biodiversity conservation plannings of provinces and centrally run cities; formulation, evaluation, approval and adjustment of biodiversity conservation plannings of provinces and centrally run cities; publicization and organization of implementation of biodiversity conservation plannings of provinces and centrally run cities.
Chapter III: Conservation and sustainable development of natural ecosystems consist of 22 articles: conservation zones and classification of conservation zones; national parks; nature reserves; wildlife reserves; landscape conservation zones; contents of a conservation zone establishment project; formulation and appraisal of national-level conservation establishment projects; decisions to establish national-level conservation zones; formulation and appraisal of provincial-level conservation zone establishment projects and decisions to establish provincial level conservation zones; use of land in conservation zones; functional sections and conservation zone boundaries; conservation zone management responsibilities; organization of management of conservation zones; rights and responsibilities of conservation zone management units and organizations assigned to manage conservation zones; responsibilities and obligations of households and individuals lawfully living in conservation zones; rights and obligations of organizations and individuals carrying out lawful activities in conservation zones; management of buffer zones of conservation zones; reporting on the current status of conservation zones’ biodiversity; survey, assessment and determination of mechanisms for sustainable development of natural ecosystems; sustainable development of natural wetlands’ natural ecosystems; sustainable development of natural ecosystems in limestone mountain areas and unused land not belonging to the forest ecosystem.
Chapter IV: Conservation and sustainable development of species consist of 5 articles: species to be included in the list of endangered precious and rare species prioritized for protection; proposals on inclusion of species in or exclusion of species from the list of endangered precious and rare species prioritized for protection; examination of dossiers of proposal on inclusion of species in or exclusion of species from the list of endangered precious and rare species prioritized for protection; decision on specifies to be included in or excluded from the list of endangered precious and rare species prioritized for protection; conservation of species on the list of endangered precious and rare species prioritized for protection.
Chapter V: Sustainable development of species consists of 13 articles: establishment of biodiversity conservation facilities; rights and obligations of organizations and individuals managing biodiversity conservation facilities; wild species banned from exploitation and wild species permitted for conditional exploitation in nature; rearing or planting of species on the list of endangered precious and rare species prioritized for protection; exchange, export, import, purchase, sale, donation, storage and transportation of species on the list of endangered precious and rare species prioritized for protection and their genetic specimens and products; rescue of species on the list of endangered precious and rare species prioritized for protection; protection of endemic or valuable crop plant varieties and domestic animal breeds in danger of extinction; protection for endemic or valuable microorganisms and fungi in danger of extinction; survey and listing of invasive alien species; control of import of invasive alien species and invasion of alien species; control of the rearing or planting of potential invasive alien species; control of the spread and development of invasive alien species; publicization of information on invasive alien species.
Chapter VI: Conservation and sustainable development of genetic resources consist of 14 articles: management of genetic resources; rights and obligations of organizations, households and individuals assigned to manage genetic resources; order of and procedures for access to genetic resources; contracts on access to genetic resources and benefit sharing; licenses for access to genetic resources; rights and obligations of organizations and individuals that are granted licenses for access to genetic resources; sharing of benefits from access to genetic resources; storage and preservation of genetic specimens; investigation, collection, assessment, supply and management of information on genetic resources; responsibilities for managing risks caused to biodiversity by genetically modified organisms and genetic specimens of genetically modified organisms; making and appraisal of reports on assessment of risks caused to biodiversity by genetically modified organisms or genetic specimens of genetically modified organisms; grant of certificates of biodiversity safety of genetically modified organisms or genetic specimens of genetically modified organisms; publicity of information on the extent of risks and measures to manage risks caused to biodiversity by genetically modified organisms or genetic specimens of genetically modified organisms; management of databases on biodiversity-related genetically modified organisms and genetic specimens of genetically modified organisms.
Chapter VII: International cooperation on biodiversity consists of 2 articles: International cooperation and implementation of treaties on biodiversity; cooperation with bordering countries.
Chapter VIII: Mechanisms and resources for biodiversity conservation and sustainable development consist of 5 articles: basic surveys, scientific research and management of information and data on biodiversity; biodiversity reports; finances for biodiversity conservation and sustainable development; environmental services related to biodiversity; compensation for damage to biodiversity.
Chapter IX: Implementation provisions consist of 3 articles: Transitional provisions; effect; implementation detailing and guidance.
The Law on Biodiversity of Vietnam officially takes effect on July 01, 2009.
