Discotheque staff not wearing uniform provided by the employer will be fined in Vietnam

Recently, the Government of Vietnam issued Decree 38/2021/ND-CP (effective from June 1, 2021) on penalties for administrative violations in the field of culture , sports, tourism and advertising, fully annulling Decree 158/2013/ND-CP. In particular, employees who do not wear uniforms or do not wear name tags provided by employers shall be fined on Vietnam

Specifically, in Clause 1, Article 15 of Decree 38/2021/ND-CP stipulates as follows:

A warning or a fine of from 200,000 VND to 500,000 VND shall be imposed for the act of not wearing the uniform or not wearing the name plate provided by the employer.

As such, discotheque employees will be fined up to 500,000 VND if they do not wear uniforms or do not wear name plates provided by employers.

On the other hand, Decree 38/2021/ND-CP also stipulates that employers must provide uniforms or name plates for employees. Failure to provide uniforms or name plates for employees will be fined from VND 500,000 to VND 1,000,000 (Clause 2, Article 15).

In addition, Decree 38/2021/ND-CP also sharply increases fines for a number of violations of regulations on business of discotheque services as follows:

  • A fine ranging from VND 10,000,000 to VND 15,000,000 shall be imposed for correcting, erasing or adding to change the contents of the license to qualify for discotheque service business; (Previously, a fine of from 5,000,000 VND to 10,000,000 VND shall be imposed according to point b, Clause 1, Article 17 of Decree 158/2013/ND-CP)
  • A fine ranging from VND 15,000,000 to VND 20,000,000 shall be imposed for providing discotheque services without ensuring the area as prescribed; (Previously a fine of from 10,000,000 VND to 15,000,000 VND shall be imposed according to point a, Clause 3, Article 16 of Decree 158/2013/ND-CP)

  •  

    A fine ranging from VND 15,000,000 to VND 20,000,000 shall be imposed for providing discotheque services at locations less than 200 meters away from schools, hospitals, religious and belief establishments, historical and cultural relics. (Previously, a fine of from VND 3,000,000 and 5,000,000 shall be imposed according to Point b, Clause 1, Article 16 of Decree No. 158/2013/ND-CP).

  • A fine ranging from VND 25,000,000 to VND 30,000,000 shall be imposed for providing discotheque services without a license as prescribed; (Previously a fine of from 20,000,000 VND to 25,000,000 VND shall be imposed according to Clause 4, Article 17 of Decree 158/2013/ND-CP)

  • A fine ranging from VND 25,000,000 to VND 30,000,000 shall be imposed for allowing other organizations or individuals to use the license to fully meet the conditions for providing discotheque services for business purposes; (Previously, a fine ranging from VND 10,000,000 to VND 15,000,000 shall be imposed according to Point b, Clause 2, Article 18 of Decree 158/2013/ND-CP).

Thus, from June 1, 2021, employees working in discotheques will be warned or fined from 200,000 VND to 500,000 VND if they do not wear uniforms or do not wear name tags provided by employers. grant. At the same time, organizations and individuals that commit violations related to discotheque business are also subject to higher fines than before.
