Criteria for Identifying Especially Difficult Villages in the Period 2016-2020

This is the content mentioned in the Draft Decision on criteria for determining especially disadvantaged hamlets and communes belonging to ethnic minorities in the mountainous regions during the period of 2016-2020.

Criteria for Determining Particularly Difficult Villages

According to the draft governing villages in ethnic and mountainous regions, as well as lowland areas with a significant population of ethnic minorities forming communities, a village is identified as particularly difficult when it meets the organizational and operational regulations of villages as per Circular 04/2012/TT-BNV and satisfies one of the following two criteria:

- Criterion 1: The poverty rate is five times higher than the national average (according to the poverty standard for 2016 – 2020).- Criterion 2: The combined poverty and near-poverty rate is three times higher than the national average (according to the poverty standard for 2016 – 2020) and meets one of the following two conditions:- There is no hardened road from the village to the commune center as per new rural criteria;- Over 20% of households lack productive land as per local regulations.

The draft decision also specifically stipulates the criteria for classifying communes into three regions:

- Region III communes are those with particularly difficult socio-economic conditions;- Region II communes are those with challenging socio-economic conditions but temporarily stable;- Region I communes are those with socio-economic conditions better than the national average.

Procedure for Determining Particularly Difficult Villages and Communes in Ethnic and Mountainous Regions

- Village Level: The village head, based on the criteria for determining particularly difficult villages, organizes village meetings and sends the documents on the results of whether the village qualifies as particularly difficult to the chairman of the commune People's Committee.- Commune Level: The chairman of the commune People's Committee, based on the criteria for classifying communes, organizes, reviews, and determines the classification of communes into regions I, II, or III, and submits a report to the district People's Committee on the results of the determination.- District Level: The district People's Committee compiles the results of determining particularly difficult villages and communes in ethnic and mountainous regions, organizes assessments, and submits a report (with accompanying documents) to the provincial level. The district assessment council comprises representatives from district leadership, related departments, and associations.- Provincial Level: Upon receiving the documents and report on the results of determining particularly difficult villages and communes in regions I, II, or III, the provincial People's Committee organizes assessments (the ethnic committee or the provincial ethnic affairs body leads, in cooperation with related departments and sectors) and submits a report to the Prime Minister (with accompanying documents) and the Committee for Ethnic Affairs for review.- Central Level: Upon receiving the application for recognizing particularly difficult villages and communes in ethnic and mountainous regions from the provincial People's Committee, the Committee for Ethnic Affairs, in cooperation with related ministries and sectors, organizes assessments and submits it to the Prime Minister for consideration and decision.

In cases where the documents do not meet regulations, within 15 working days from the date of receipt, the assessment bodies must issue a written response and provide guidance for localities to take corrective actions.

Dossier for Proposal for Recognizing Particularly Difficult Villages and Communes in Ethnic and Mountainous Regions

- A report from the provincial People's Committee to the Prime Minister proposing recognition of particularly difficult villages and communes in ethnic and mountainous regions;- A compiled list of particularly difficult villages and communes in ethnic and mountainous regions;- The assessment record and related documents;- A document from the provincial People's Committee to the Committee for Ethnic Affairs requesting an assessment.
