Covid-19 Pandemic: Notary and Law Practice Organizations May Continue to Operate

This is a noteworthy provision in Official Dispatch 1221/BTP-PLHSHC dated April 3, 2020, from the Ministry of Justice on the implementation of Directive 16/CT-TTg and Official Dispatch 2601/VPCP-KGVX from the Office of the Government of Vietnam on the prevention and control of the COVID-19 pandemic.

To be specific: Following the directives of the Prime Minister of the Government of Vietnam in Directive 16/CT-TTg dated March 31, 2020, on urgent measures to prevent and control the COVID-19 pandemic and Official Dispatch 2601/VPCP-KGVX dated April 3, 2020, of the Office of the Government of Vietnam on the implementation of Directive 16/CT-TTg on pandemic prevention and control, the Ministry of Justice requests the People's Committees of provinces and centrally-run cities to direct the Departments of Justice, district and commune People's Committees, and organizations operating in the field of judicial support within their areas to implement the following tasks:

- Notary practices, lawyers, and the Centers for Secured Transaction Registration (as specified in Section 2 of Official Dispatch 2601/VPCP-KGVX) are allowed to continue their operations.

- The agencies and units providing public services specified in Section 4 of Official Dispatch 2601/VPCP-KGVX (issuance of judicial record cards, certification, civil status resolution requests) are responsible for organizing their work in accordance with their specific conditions, without allowing delays.

- The heads of the organizations, agencies, and units mentioned above are responsible for ensuring absolute safety and fully implementing the pandemic prevention and control measures prescribed, paying special attention to the following measures:

+ Services or work content that can be performed online or through communication means (telephone, postal services, the Internet...) should use these transaction methods;

+ In urgent cases where direct transactions are mandatory, strict measures must be taken including wearing masks and maintaining a safe distance when communicating. The heads of the organizations, agencies, and units are responsible for arranging adequate pandemic prevention means as prescribed and recommended by health authorities.

During the organizational process, the People's Committees of provinces and centrally-run cities should promptly inform the Ministry of Justice about any difficulties or obstacles (if any) for the Ministry of Justice to compile, guide or report to the competent authority for handling.
