Cases of Exemption from Military Service 2017

Military service is one of the top concerns of young people today. The Military Service Law 2015 provides regulations on cases of exemption from the implementation of military service (NVQS).

According to the provisions of the Military Service Law 2015, the annual conscription is only conducted once a year in February or March. In necessary cases due to national defense and security reasons, a second conscription may be conducted. For localities with disasters or dangerous epidemics, the time for conscription can be adjusted.

This time regulation also applies to the conscription for participation in People's Public Security service.

Corresponding to one conscription period in February or March, the medical examination for military service (NVQS) will take place from November 1 to December 31 each year. The medical examination call for NVQS will be sent to citizens 15 days in advance.

Thus, the 2017 military service medical examination period will be from November 1, 2016 – December 31, 2016 and the conscription period will be in February or March 2017.

According to legal regulations, the current cases eligible for exemption from performing NVQS include:

  1. Not meeting health standards:

Joint Circular 16/2016/TTLT-BYT-BQP regarding medical examination for performing military service specifies the diseases that are exempt from military registration, and not accepted into regular military service, including:

- Mental disorders (ICD10 code: F20-F29);- Epilepsy (ICD10 code: G40);- Parkinson’s disease (ICD10 code: G20);- Blindness in one eye (ICD10 code: H54.4);- Deafness (ICD10 code: H90);- Sequelae of bone, joint tuberculosis (ICD10 code: B90.2);- Sequelae of leprosy (ICD10 code: B92);- Malignancies (ICD10 codes: C00 to C97; D00 to D09; D45-D47);- HIV infection (ICD10 codes: B20 to B24, Z21);- Persons with extremely severe and severe disabilities.

According to point c, clause 3, Article 4 of Circular 140/2015/TT-BQP prescribing the selection and conscription of citizens, those with grade 3 health with refractive errors (myopia 1.5 diopters or more, hyperopia of all degrees), drug addiction, HIV/AIDS infection, are not called up for military service.

  1. Children of martyrs, children of first-class war invalids;
  2. One elder or younger brother of martyrs;
  3. One child of second-class invalids; one child of a diseased person with 81% or more work capacity reduction; one child of a person infected with orange agent with 81% or more work capacity reduction;
  4. Persons working in cryptographic organizations who are not soldiers, People's Public Security officers;
  5. officials and public employees, youth volunteers assigned to work in areas with specially difficult socio-economic conditions as stipulated by law for 24 months or more.

Previously, point d, clause 2, Article 4 of Circular 167/2010/TT-BQP regulating the standards for military recruitment stated: "Citizens with tattoos (using needles) of disturbing, monstrous, provocative, violent images in exposed positions such as face, neck, hands (from the lower 1/3 of the arms down); legs (from the lower 1/3 of the thighs down), will not be conscripted into the Army." Therefore, many young people took advantage of this regulation to evade military service obligations.

However, Circular 140/2015/TT-BQP issued to replace Circular 167 abolished this provision.

Military service is the honorable duty of citizens of the age eligible for military service, regardless of ethnicity, social status, belief, religion, educational level, occupation, or residence. Only legally stipulated cases are exempted from participating in NVQS.
