Circular No. 16/2020/TT-BQP stipulating the application of disciplinary measures, order, procedures, statute of limitations, duration, and authority to handle disciplinary actions within the Ministry of National Defense takes effect from April 8, 2020.

This Circular specifically regulates the authority to discipline individuals who violate discipline and fall under the management jurisdiction of the Ministry of National Defense as follows:
- Squad Leader and equivalent positions have the authority to reprimand soldiers.
- Platoon Leader and equivalent positions have the authority to reprimand up to squad leaders and equivalent positions.
- Company Commander, company political officer, border post commander, and equivalent positions have the authority to:
+ Reprimand up to platoon leader and equivalent; officers, professional soldiers up to captain rank; officials, workers, and public employees in the defense sector with salary levels equivalent to captain rank;
+ Warn up to squad leader and equivalent; non-commissioned officers up to sergeant rank; officials, workers, and public employees in the defense sector with salary levels equivalent to first lieutenant.
- Battalion Commander, battalion political officer, border post commander, and equivalent positions have the authority to:
+ Reprimand up to company commander, company political officer; border post commander and equivalent; officers, professional soldiers up to major rank; officials, workers, and public employees in the defense sector with salary levels equivalent to major rank;
+ Warn up to platoon leader and equivalent; officers, professional soldiers up to captain rank; officials, workers, and public employees in the defense sector with salary levels equivalent to captain rank;
+ Demote military rank from private first class to private.
- Regiment Commander, brigade commander, regiment commissioner, brigade commissioner, and equivalent positions have the authority to:
+ Reprimand up to battalion commander, battalion political officer; border post commander and equivalent; officers, professional soldiers up to lieutenant colonel rank; officials, workers, and public employees in the defense sector with salary coefficients below 6.20;
+ Warn up to company commander, company political officer; border post commander and equivalent; officers, professional soldiers up to major rank; officials, workers, and public employees in the defense sector with salary levels equivalent to major rank;
+ Demote or dismiss squad leaders and equivalent;
+ Demote or strip military ranks up to sergeant.
- Division Commander, division commissioner, and equivalent positions have the authority to:
+ Reprimand up to regiment commander, regiment commissioner, and equivalent; officers, professional soldiers up to colonel rank; officials, workers, and public employees in the defense sector with salary coefficients below 6.80;
+ Warn up to battalion commander, battalion political officer, and equivalent; officers, professional soldiers up to lieutenant colonel rank; officials, workers, and public employees in the defense sector with salary coefficients below 6.20;
+ Demote or dismiss up to deputy battalion commander, deputy battalion political officer, and equivalent;
+ Demote or strip military ranks up to staff sergeant.
- Commanders, commissioners of Naval Regions, and the Vietnam Coast Guard Regions have the authority to:
+ Reprimand up to naval detachment commander, naval detachment political officer, and equivalent; officers, professional soldiers up to colonel rank; officials, workers, and public employees in the defense sector with salary coefficients below 6.80;
+ Warn up to ship captain, ship political officer, and equivalent; officers, professional soldiers up to lieutenant colonel rank; officials, workers, and public employees in the defense sector with salary coefficients below 6.20;
+ Demote or dismiss up to deputy ship captain, deputy ship political officer, and equivalent;
+ Demote or strip military ranks up to staff sergeant.
- Commanders, commissioners of: Vietnam Coast Guard Command; Command 86; Hanoi Capital Command, branches, and equivalent positions have the authority to:
+ Reprimand up to division commander, division commissioner; commanders, commissioners of Vietnam Coast Guard Regions, and equivalent positions;
+ Warn up to regiment commander, brigade commander, regiment commissioner, brigade commissioner, and equivalent; officers up to colonel, excluding those specified in Point a of this Clause;
+ Reduce salary grades, demote officers up to major rank, professional soldiers up to lieutenant colonel, and officials, workers, and public employees in the defense sector with salary coefficients below 6.20;
+ Demote or dismiss up to deputy regiment commander, deputy brigade commander, deputy regiment commissioner, brigade commissioner, and equivalent positions.
- Region commanders, commissioners of military regions, army branches, Border Defense Force, army corps; Chief of Logistics General Department, Technical General Department, Defense Industry General Department, General Department II; Chief Inspector of the Ministry of National Defense, and equivalent positions have the authority to:
+ Reprimand up to division commander, division commissioner; commanders, commissioners of naval regions; chief of provincial (city) military command; provincial (city) Border Defense Force and equivalent positions;
+ Warn up to regiment commander, brigade commander, regiment commissioner, brigade commissioner, and equivalent; officers up to colonel (excluding those specified in Point a of this Clause);
+ Reduce salary grades, demote officers up to lieutenant colonel, and officials, workers, and public employees in the defense sector with salary coefficients below 6.20;
+ Demote or dismiss up to regiment commander, brigade commander; regiment commissioner, brigade commissioner; chief of district military command; district political officer.
- Chief of General Staff, Chief of General Department of Politics has the authority to discipline as specified in Clause 9 of this Article.
- Minister of National Defense has the authority to discipline the subjects under the authority as specified.
