Allowance rates for part-time officials in communes and hamlets in Vietnam from 2021

Due to the impact of the Covid-19 pandemic, the statutory pay rate will not increase and will remain at 1,490,000 VND/month. From 2021, allowances calculated based on the statutory pay rate will also be affected, particularly the allowances for part-time officials in communes and hamlets in Vietnam.

According to the provisions of Clause 5, Clause 6, Article 2 Decree 34/2019/ND-CP amending and supplementing Article 14 Decree 92/2009/ND-CP, the allowance rates for part-time officials in communes and hamlets are as follows:

- commune-level part-time officials are entitled to allowance, social insurance benefits, and health insurance benefits. The state budget implements a fund package for allowances, including support for social insurance and health insurance, to be paid monthly to commune-level part-time officials according to the administrative unit classification decision for communes, wards, and commune-level towns as follows:

- Type 1 is allocated an allowance fund equal to 16.0 times the statutory pay rate;- Type 2 is allocated an allowance fund equal to 13.7 times the statutory pay rate;- Type 3 is allocated an allowance fund equal to 11.4 times the statutory pay rate.

- part-time officials at the hamlet, residential group are Party Cell Secretary; Hamlet Chief or Residential Group Leader. The state budget allocates an allowance fund equal to 3.0 times the statutory pay rate to be paid monthly. Specifically, for hamlets with 350 households or more, hamlets in key, complicated security and order areas as decided by competent authorities; hamlets in border communes or islands are allocated an allowance fund equal to 5.0 times the statutory pay rate.

However, due to the impact of the Covid-19 pandemic, the Politburo and the National Assembly have agreed not to adjust the statutory pay rate for officials and public employees, armed forces from July 1, 2020, until further notice as per Conclusion 77-KL/TW dated June 5, 2020, and Resolution 122/2020/QH14 dated June 19, 2020. Recently, in the newly passed Resolution, the National Assembly has assigned the Government of Vietnam to implement several measures to manage the financial - state budget tasks in 2021, including officially not adjusting the statutory pay rate in 2021. Thus, according to the above provisions, the statutory pay rate for officials and public employees in 2021 remains at 1.49 million VND/month as currently. Therefore, the allowance rates for part-time officials in communes and hamlets from 2021 are calculated as follows:

For commune-level part-time officials:

Note: Based on the above allowance fund and the specific characteristics of each commune level, management requirements, regular expenditure rate, the local budgetary sources for salary policy reform, the provincial People's Committee submits to the same level People's Council for specific regulations on the following contents:

- Titles and number of commune-level part-time officials equal to or less than:- Type 1 maximum 14 people;- Type 2 maximum 12 people;- Type 3 maximum 10 people

- Allowance rates for each title, concurrent title allowance for commune-level part-time officials.

- Operating fund allocation of socio-political organizations at the commune level suitable to the local actual conditions.

For part-time officials in hamlets, residential groups:

Note: Based on the above allowance fund and the specific characteristics of each commune level, management requirements, regular expenditure rate, and local budget revenue, the provincial People's Committee submits to the same level People’s Council for regulations on allowance rates for each title, concurrent title allowance for part-time officials, and remuneration for those directly participating in hamlet, residential group tasks.
