Currently, during the recruitment season for the year 2018, Legal Secretary has received quite a few inquiries regarding cases of deferment of military service. So, according to the current regulations, which cases are eligible for deferment of military service? All will be addressed in this article.
According to the current regulations in Joint Circular 175/2011/TTLT-BQP-BGDDT and Joint Circular 13/2013/TTLT-BQP-BGDDT, the following cases will be temporarily exempted from military service:
(1) Citizens with a sibling who is a non-commissioned officer or soldier currently serving in the army, or a student who is a non-commissioned officer or soldier studying at military schools or non-military schools according to the Ministry of Defense’s plan.
In this case, if the sibling of the citizen demobilizes and the citizen is still within the age of military service and meets all other conditions, the citizen must perform military service when ordered.
(2) Citizens who are studying at schools within the national education system in full-time formal education including:
- High schools, multi-level schools, boarding ethnic schools, semi-boarding ethnic schools, gifted schools, prep schools;- Intermediate vocational schools, vocational training schools, vocational colleges;- Universities, colleges;- Academies, research institutes tasked with master's, doctoral, or equivalent training;- Schools run by foreign organizations or individuals, international organizations, and overseas Vietnamese authorized to invest in Vietnam.
(3) Students attending regular education programs at lower secondary or upper secondary levels at educational institutions.
(4) Citizens studying abroad at schools with a training duration of 12 months or more.
(5) Citizens studying at the schools as mentioned above from the date they have completed the enrollment procedures and are studying at the school. If a citizen receives both the enrollment notice and the conscription order at the same time, the conscription order must be complied with.
In this case, the citizen has the right to reserve the result of the enrollment examination to fulfill military service obligations.
Some notes:
- Citizens granted a temporary exemption as per regulations are only allowed a temporary exemption for the first concentrated training course and are not exempted for subsequent courses.- The duration of a concentrated training course is calculated from the date specified by the school for enrollment (stated in the enrollment notice) until graduation.- A course is only conducted at one training level, and in the case of continuous integrated training, it must be uninterrupted.
The Joint Circular 175/2011/TTLT-BQP-BGDDT remains in effect at the present time.
