Adventure Tourism and Legal Regulations to Know (Draft)

According to the provisions of the Draft Circular on adventure tourism activities: Persons who have consumed alcohol, beer, or used stimulants are prohibited from participating in adventure tourism programs.

The Ministry of Culture, Sports and Tourism is seeking public opinion on the Draft Circular regarding regulations on adventure tourism activities, which includes several notable points as follows:

More than 20 adventure tourism activities

Such as: Canoeing; canoeing with parasailing; Kayak boating; horseback riding; mountain biking; tightrope walking; rope waterfall crossing; hunting; rafting; scuba diving; rock climbing; cave exploration; sandboarding; grass skiing; artificial ice skating; artificial snow skiing; jungle exploration; water slide games; jet skiing; surfing.

And some other adventure sports activities as prescribed by the Minister of Culture, Sports and Tourism.

02 categories of individuals prohibited from participating in adventure tourism

According to the Draft Circular, the following individuals are prohibited from participating in adventure tourism activities or programs:

- Tourists with a history of cardiovascular disease, high blood pressure, respiratory illnesses, and other diseases as advised by doctors;- Individuals who have consumed alcohol, beer, or used stimulants.

Requirements for participants in adventure tourism

- Must sign a commitment to ensure health conditions and appropriate age for the registered adventure tourism program;- Must be trained in the necessary skills and maneuvers before participating in the adventure tourism program;

Additionally, participants in adventure tourism must be aware of the following rights and obligations:

Rights:

- To be fully equipped with necessary specialized equipment and have a guide monitoring and supervising when participating in adventure tourism activities;- To be informed about the schedule and evacuation plan in case of emergency;- To be provided with necessary support equipment and communication devices to contact between team members and related persons;

Obligations:

- To take personal responsibility if any accidents or incidents occur related to the provision of false information about age, personal health conditions, or failure to follow the guide's instructions;- To comply with legal regulations on environmental protection;- To adhere to the regulations on national defense, security, and local rules at the place and venue of the adventure tourism activities and programs.

Requirements for adventure tourism guides:

- To meet the conditions for practicing as a guide according to legal regulations;- To have a certificate of expertise corresponding to the sport serving tourists in the adventure tourism program issued or recognized by the General Department of Sports or a professional sports organization;- To hold a certificate of completion of training in first aid, emergency rescue, and incident management organized by a competent State authority.

Equipment, tools for supporting adventure tourism participants

Includes:

- Personal protective equipment;- Communication system: Walkie-talkies, maps, route diagrams;- Identification system for route guidance and danger warnings along the entire tourism route;- Instruments and first aid kits.

The aforementioned equipment, tools, and support instruments must ensure technical safety and quantity to serve tourists; there must be backup equipment and tools in case of loss or sudden technical failure to ensure tourists' safety.
