12 Laws Officially Effective from July 01, 2020 (Part 3)

Continuing from Part 1 and Part 2, Thu Ky Luat respectfully presents to our Customers and Members some prominent and important contents of the 12 Laws effective from July 1, 2020 (Part 3) as follows:

9. Mandatory Quality Control of Audits from July 1, 2020

This significant new provision is stipulated in the Amended State Audit Law 2019, which was passed by the National Assembly on November 26, 2019.

Clause 8 of Article 1 of the Amended State Audit Law 2019 adds regulations on audit quality control. Specifically:

- The State Audit shall organize and conduct audit quality control to ensure that all audit activities are checked and reviewed for quality;- Audit quality control is performed regularly and continuously for all audit activities of the State Audit;- The State Auditor General shall specify the organization and implementation of audit quality control.

10. Four Restricted Information Resources in Libraries

On November 21, 2019, the National Assembly officially passed the Library Law 2019, which will take effect on July 1, 2020.

Article 7 of the Library Law 2019 stipulates information resources restricted in libraries, including:

- Information resources whose widespread use may affect the interests of the State, or the lawful rights and interests of agencies, organizations, and individuals;- Information resources classified as state secrets, restricted use, conditionally accessible, restricted access as per the laws on state secret protection, information access, and archiving;- Original documents that are ancient, rare, and cultural heritage information resources preserved in libraries;- Original documents that are damaged.

11. Five Cases for Early Termination of Militia and Self-Defense Service

The Militia and Self-Defense Law 2019 was passed by the National Assembly on November 22, 2019. This law specifies the cases for early termination of militia and self-defense service, including:

- Female militia members who are pregnant or nursing children under 36 months old, male militia members solely raising children under 36 months old;- Those who are unable to perform militia duties due to health reasons;- Those with suddenly difficult family circumstances that prevent them from continuing to perform militia duties, certified by the Chairman of the commune-level or district-level People's Committee where there is no commune-level administrative unit, or the head of the agency or organization;- Those who receive a call-up order for military service or duty in the People's Police; those appointed as officials and public employees, defense workers, police workers;- Those who receive notification and enrollment into higher education institutions, vocational institutions, state agency schools, political organizations, socio-political organizations; those with notification and departing for labor, study, or work abroad.

The Chairman of the commune-level People's Committee, Chairman of the district-level People's Committee where there is no commune-level administrative unit, or the head of the agency or organization shall decide on the early termination of militia and self-defense service.

12. Protection Period for State Secrets Effective from July 1, 2020

The protection period for state secrets is one of the notable contents stipulated in the State Secrets Protection Law 2018 passed by the National Assembly on November 15, 2018.

The protection period for state secrets is calculated from the date the confidentiality level of the state secret is determined to the end of the following periods:

- 30 years for state secrets of top secret level;- 20 years for state secrets of confidential level;- 10 years for state secrets of secret level.

Additionally, the protection period for state secrets in activities may be shorter than the above-stipulated periods and must be specified in the document or material containing state secrets when determining the confidentiality level.

Note: The protection period for state secrets regarding locations ends when the competent authority no longer uses those locations to hold state secrets.
