Continuing from Part 1, Thu Ky Luat respectfully introduces to our esteemed customers and members some notable and important contents of 12 Laws that came into effect from July 1, 2020 (Part 2) as follows:

5. 04 entities granted ordinary passports under simplified procedures

This is a new noteworthy provision in the Law on Entry, Exit of Vietnamese Citizens 2019, passed by the National Assembly on November 22, 2019.

Specifically, Article 17 of the Law on Entry, Exit of Vietnamese Citizens 2019 stipulates the entities granted ordinary passports under simplified procedures, including:

- Persons abroad who have lost their ordinary passports and wish to return to Vietnam immediately;- Persons with a written deportation decision by competent authorities of the host country but do not possess a passport;- Persons returning to Vietnam under international treaties or agreements on the readmission of citizens;- Persons granted an ordinary passport for reasons of national defense and security.

Note: Ordinary passports issued under simplified procedures are valid for no more than 12 months and cannot be extended.

6. Change in principles for determining the total number of commune-level People's Council deputies from July 1, 2020

On November 22, 2019, the National Assembly officially passed the Law on Government Organization and Law on Organization of Local Government Amendments 2019.

From July 1, 2020, the determination of the total number of commune-level People's Council deputies will be based on the following principles:

- Mountainous communes, highlands, and islands with a population of up to two thousand shall elect fifteen deputies;- Mountainous communes, highlands, and islands with a population over two thousand and below three thousand shall elect nineteen deputies;- Mountainous communes, highlands, and islands with a population from three thousand to four thousand shall elect twenty-one deputies; if the population exceeds four thousand, one deputy shall be added for each additional thousand people, but the total number shall not exceed thirty deputies;- Communes not falling into the above categories with a population of up to five thousand shall elect twenty-five deputies; if the population exceeds five thousand, one deputy shall be added for each additional two thousand five hundred people, but the total number shall not exceed thirty deputies.

Note: The Standing Committee of the commune-level People's Council comprises the Chairman of the People's Council, one Vice Chairman of the People's Council, and members who are Heads of the People's Council committees.

7. From July 1, 2020, an additional form of promotion review for civil servants

This is a new provision stipulated in the Law on Cadres, Civil Servants and Law on Public Employees Amendments 2019, passed by the National Assembly on November 25, 2019.

Specifically, Clause 8 of Article 1 of the Law on Cadres, Civil Servants and Law on Public Employees Amendments 2019 amends and supplements Article 44 of the Law on Cadres, Civil Servants 2008 regarding the promotion of civil servants as follows:

- The promotion of civil servants must be based on job positions, appropriate to the civil service structure of the agency, organization, unit, and conducted through promotion examinations or promotion reviews; (Currently, according to the Law on Cadres, Civil Servants 2008, it is only conducted through promotion examinations)- Civil servants who meet the standards and conditions for holding a position corresponding to a higher rank may register for promotion examinations or promotion reviews;- Promotion examinations and promotion reviews must ensure principles of competition, transparency, objectivity, and legality;- Civil servants who pass the promotion examination or promotion review shall be appointed to a higher rank and considered for placement in a corresponding job position.

8. 04 cases where visas can be converted from July 1, 2020

On November 25, 2019, the National Assembly officially passed the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam Amendments 2019.

From July 1, 2020, the following cases are allowed to convert visa purposes (as currently, visas are valid for single entry or multiple entries and cannot convert purposes), specifically:

- Having documents proving they are investors or representatives for foreign organizations investing in Vietnam as stipulated by Vietnamese law;- Having documents proving the relationship as father, mother, wife, husband, child with the person inviting or sponsoring them;- Being invited or sponsored by agencies or organizations for work and having a work permit or confirmation not subject to work permit issuance as stipulated by labor law;- Entering with an electronic visa and having a work permit or confirmation not subject to work permit issuance as stipulated by labor law.

In case of visa purpose conversion, a new visa with appropriate symbols and duration fitting the converted purpose shall be issued.
