06 regulations to know about citizens' electronic identity in Vietnam

An electronic identity is a collection of digital data in the National Population Database, Citizens Identity Database and National Immigration Database of Vietnam that allows to uniquely identify an individual in the electronic environment. The electronic identification and authentication on the basis of these databases are specified in detail at Decision 34 2021/QD-TTg. Here's what to know about electronic identities.

1. Information contained in an electronic identity in Vietnam

According to Decision 34/2021/QD-TTg, the electronic identity of Vietnamese citizens includes:

- Personal identification number;

- Full name, middle name and first name;

- Date of birth;

- Gender;

- Portrait and fingerprint photo.

For the electronic identity of foreigners, there will be:

- Passport number or international travel document number;

- Full name, middle name and first name;

- Date of birth;

- Gender;

- Nationality;

- Portrait photo and fingerprint (if any).

3. Using an electronic identity account in Vietnam

The creation of an individual's electronic identity account to carry out administrative procedures in the electronic environment must use the electronic identity provided by the Ministry of Public Security of Vietnam 

The use of electronic identification accounts created by the Electronic Identification and Authentication System of the Ministry of Public Security to carry out administrative procedures in the electronic environment shall be decided by the public service portal management agency.

The use of electronic identification and electronic authentication accounts created by the Electronic Identification and electronic authentication of the Ministry of Public Security to perform activities other than the above cases, which are selected and used by organizations and individuals themselves.

4. Cases of locking electronic identification accounts in Vietnam

The eID account will be locked in the following 5 cases:

(1) When the electronic identity subject requests to lock his electronic identity account.

(2) At the request of the proceeding agency, the competent authority or the service user.

(3) When the e-identity subject violates the terms of service agreed upon with the e-identity account issuing authority.

(4) When performing reset or cancellation of personal identification number.

(5) When the electronic identity subject dies.

5. Can the e-ID account be locked and restored?

Decision 34/2021/QD-TTg of Vietnam allows the recovery of e-ID accounts when:

- The e-identity subject requests the recovery of the e-identity account that previously requested the lock.

- The prosecuting agency, the competent authority or the service user requesting the recovery of the e-identity account that previously requested to be locked.

- When the e-identity subject has overcome the violation of the terms of service agreed with the e-identity account-granting agency and requests to restore the e-identity account.

6. Update electronic identity in Vietnam

When there is a change in electronic identity information, the National Population Database, Citizens Identity Database and the National Immigration Database update and the National Database on Immigration to update and synchronize information on the Electronic Identification and Authentication System and notify individuals with electronic identities.

In case of changing electronic identity information that has not been adjusted in the National Population Database, Citizens Identity Database and the National Immigration Database, The citizen identification database and the national immigration database shall be adjusted according to the provisions of law of Vietnam

- For individual electronic identification accounts created by the National Public Service Portal or ministerial and provincial public service portals before November 9, 2021, before January 1, 2023 must be authenticated with the electronic identity provided by the Ministry of Public Security of Vietnam.

- From November 9, 2021, until January 1, 2023, if the national, ministerial and provincial public service portals are not ready to connect to the electronic identification and authentication system of The Ministry of Public Security, the creation of an account to carry out administrative procedures in the electronic environment continues to use the electronic identity provided by the e-identification providers connected and integrated with the Electronic Identity Exchange Platform on the National Public Service Portal.

Decision 34/2021/QD-TTg of Vietnam takes effect from November 9, 2021.
