04 Prominent New Policies Officially Effective from May 2018

From May 01, 2018, numerous new regulations related to the fields of customs, export-import, accounting, auditing, and criminal procedure will come into effect. Notably, the following 04 contents are as follows.

1. Quota-free Import of Salt and Poultry Eggs Originating from ASEAN Countries

According to Circular 04/2018/TT-BCT, the following conditions must be met for salt and eggs to be exempt from import quotas:

- Originating from ASEAN countries;- Complying with the origin regulations in the ASEAN Trade in Goods Agreement;- Possessing a Certificate of Origin Form D as per current legal regulations.

2. Increased Fines in the Field of Accounting up to VND 100 Million from May 1, 2018

This is a new amendment according to Decree 41/2018/ND-CP, replacing Decree 105/2013/ND-CP, on administrative penalties in the fields of accounting and independent auditing.

The maximum fine for a single administrative violation in the fields of accounting and independent auditing is VND 50,000,000 for individuals and VND 100,000,000 for organizations.

Additionally, another notable point in Decree 41/2018/ND-CP is the change in the duration of certificate revocation in certain cases. Specifically:

- Revoking the Certificate of Registration for Accounting Services and the Certificate of Registration for Auditing Services for a period of 03 to 06 months;- Revoking the Certificate of Eligibility for Business in Accounting and Auditing Services for a period of 01 to 12 months.

3. Regulations on Procedures for Asset Valuation in Criminal Proceedings

Decree 30/2018/ND-CP, effective from May 1, 2018, stipulates the asset valuation procedures in criminal proceedings, including the following steps:

- Step 1: Receive the request for asset valuation;- Step 2: Establish the Asset Valuation Council;- Step 3: Conduct surveys on the assets to be valuated, price surveys, and collect related information;- Step 4: Hold an asset valuation meeting and issue conclusions.

4. Guidelines for Inspection Procedures of Import and Export Goods at Border Checkpoints

For export goods, the inspection of documents for people and transport vehicles that have completed exit procedures is conducted at Control Barrier No. 1.

For import goods:

- At Barrier No. 1: Inspect the documents of people and transport vehicles to ensure they meet the conditions to enter Vietnamese territory;- At Barrier No. 2: Inspect entry documents of people and transport vehicles after completing entry procedures into Vietnam.

The above content is based on Circular 44/2018/TT-BQP amending and supplementing some provisions of Circular 09/2016/TT-BQP on the management of land border checkpoints.
