Below is a noteworthy provision in Decree 133/2020/ND-CP detailing the implementation of certain articles of the Law on Execution of Criminal Judgments.

What are regulations on regime for board and clothing for inmates in Vietnam?(Illustration)

Decree 133/2020/ND-CP (effective from December 25, 2020) will replace Decree 117/2011/ND-CP and stipulate the regime for board and clothing for inmates as follows:

1. Regime for board for Inmates in Vietnam

According to Article 7 of Decree 133/2020/ND-CP, the regime for board for inmates in Vietnam as follows:

- The State ensures each inmate a monthly standard ration including: 17 kg of regular rice; 15 kg of vegetables; 1 kg of pork; 1 kg of fish; 0.5 kg of sugar; 0.75 liters of fish sauce; 0.2 liters of cooking oil; 0.1 kg of monosodium glutamate; 0.5 kg of salt; Other spices equivalent to 0.5 kg of regular rice; Fuel equivalent to 17 kg of firewood or 15 kg of coal (Note: The foods, ingredients, and fuel must ensure quality and average market price at local time pricing);

- Additionally, during holidays and Tet, inmates are given additional food, but not exceeding 5 times the normal daily food standard.

- Inmates working in heavy, hazardous, dangerous occupations as defined by law are given an increased food ration, but the total food amount must not exceed twice the normal daily standard.

Note: Based on the requirements to ensure the health of inmates during detention, labor, and study at the place of sentence execution, the head of the inmate detention facility can decide to adjust the food ration to match reality, so that the inmates can consume the full standard.

Compared to the past, in Article 8 of Decree 117/2011/ND-CP as amended by Article 1 of Decree 90/2015/ND-CP, the regime for board for inmates ensured a monthly standard ration of 17 kg of regular rice; 0.7 kg of meat, 0.8 kg of fish; 0.5 kg of average sugar; 1 kg of salt; 15 kg of vegetables; 0.75 liters of fish sauce; 0.1 kg of monosodium glutamate; fuel equivalent to 17 kg of firewood or 15 kg of coal. Specifically, during holidays and Tet according to the law, inmates are given additional food but not exceeding five times the normal daily food standard. For inmates working in heavy, hazardous labor as defined by law, the ration can be increased by 15% compared to the standard mentioned above.

Thus, it can be seen that the regime for board for inmates have increased compared to the past, with an addition of 0.2 kg of fish, 0.3 kg of pork, and the inclusion of cooking oil and other spices. Particularly, inmates working in heavy, hazardous, dangerous occupations as defined by law will have their food ration increased but the total meal must not exceed twice the normal food standard (previously, only a 15% increase compared to the standard).

Besides the standard rations mentioned above, inmates also enjoy the following policies:

- Inmates can use their money and gifts to eat additional food, but not exceeding 3 times the monthly food standard per inmate and must go through the deposit and canteen system of the detention facility serving the inmates.

- Each sub-camp of the inmate detention facility must organize at least one collective kitchen. The standard catering tools for a collective kitchen serving 100 inmates include: 1 food storage cabinet with mesh or glass cover, 3 large frying pans, 1 small frying pan, 1 large pot used for 3 years; different types of knives, cutting boards, wash basins, baskets, strainers, bowls, chopsticks used for 1 year, and other necessary catering equipment for cooking and serving meals for inmates.

- Catering tools for one meal serving 6 inmates include 1 food cover, 1 rice pot, 1 soup pot used for 2 years; 2 food plates, 1 sauce bowl, 1 rice ladle, 1 soup ladle used for 1 year.

- Catering tools for one inmate for each meal include 1 multi-compartment container with 4 sections or a 5-compartment tray made of plastic for holding food and 1 plastic spoon used for 2 years.

2. Regime for clothing and personal belongings for Inmates in Vietnam

According to Article 8 of Decree 133/2020/ND-CP, the regime for clothing and personal belongings of inmates in Vietnam is as follows:

- Inmates are provided with: 2 sets of long clothes made of regular fabric according to a standardized model/year; 2 sets of underwear/year; 2 face towels/year; 2 personal mats/year; 2 pairs of slippers/year; 1 hat (for male inmates) or 1 conical hat (for female inmates)/year; 1 plastic raincoat/year; 4 toothbrushes/year; 600 g of toothpaste/year; 3.6 kg of soap/year; 800 ml of shampoo/year; 1 mosquito net/3 years; 1 blanket/4 years (from Thua Thien Hue province northward and 5 Central Highlands provinces, a cotton blanket cover weighing no more than 2 kg is provided, the other provinces provide fiber blankets); 1 warm coat/3 years (provided from Thua Thien Hue province northward and 5 Central Highlands provinces, the remaining provinces and central-run cities don't provide).

- Female inmates are provided with necessary sanitary items equivalent to 2 kg of regular rice/person/month.

- Inmates participating in labor or vocational training are provided with 2 sets of protective labor clothing and other necessary protective labor tools each year.

Compared to previous regulations in Decree 117/2011/ND-CP, the clothing policies for inmates have increased by adding 1 more toothbrush. Furthermore, a cotton blanket with a cover weighing no more than 2 kg is issued within 4 years for inmates in the 5 Central Highlands provinces (previously, 1 mosquito net and 1 blanket were provided; for inmates in prisons from Da Nang city southward, including the 5 Central Highlands provinces, a fiber blanket was issued).
