Vietnam: Teachers and instructors for inmates to receive a salary of 372,500 VND per session

This is the notable content of Decree 133/2020/ND-CP, which provides detailed regulations on the implementation of several articles of the Law on Criminal Judgments Execution, just promulgated on November 9, 2020.

To be specific, Article 13 of Decree 133/2020/ND-CP stipulates policies for cultural education for inmates provided by teachers, officials, and soldiers aiming to popularize culture, educate on laws and citizenship, propagandize and popularize laws, and organize literacy programs for inmates who are illiterate or relapsed into illiteracy, as follows:

- For inmates under 18 years old who are illiterate or have not completed primary education, compulsory primary education must be provided. For those who have not completed secondary education, based on the inmate's records and transcripts, organize appropriate secondary education programs according to the conditions of the unit. Inmates are encouraged to self-study cultural subjects; foreign inmates and ethnic minority inmates who do not know Vietnamese are encouraged to learn Vietnamese. Inmates who are learning culture but finish their prison term will have their learning results preserved to continue studying at national education system institutions.

- Depending on the program, appropriate textbooks and teaching materials shall be used according to the regulations and guidance of the Ministry of Education and Training. Cultural education time for inmates is arranged for one day per week, decided by the Head of the inmate detention facility, excluding Sundays, holidays, and Tet. The detention facilities shall organize cultural classes for inmates and teach Vietnamese to those who do not speak Vietnamese. The Head of the inmate detention facility, based on the actual situation and inmates' cognitive abilities, shall decide the form, time, and teaching methods accordingly. The State encourages families of inmates, agencies, organizations, and individuals to support with textbooks, notebooks, teaching materials, books, newspapers, sports equipment, cultural and entertainment activities for inmates, ensuring compliance with relevant laws.

- Teachers providing cultural education to inmates include officials and soldiers from the inmate detention facilities or local educational institutions. Inmates who have shown reform progress, have educational qualifications, pedagogical skills, a good background, and are not leaders, commanders, professional criminals, thugs, violent, infected with infectious diseases, drug addicts, or national security offenders can be arranged to support officials and soldiers in teaching literacy to other inmates.

In addition, Article 14 of Decree 133/2020/ND-CP stipulates that teachers, officials, and soldiers teaching culture, law education, citizenship education, law dissemination, and popularization to inmates will receive an allowance of one session (04 hours) equivalent to 0.25 of the statutory pay rate.

Currently, due to the impact of the Covid-19 pandemic, the National Assembly has agreed with the Government of Vietnam's proposal to delay the adjustment of the statutory pay rate increase from 1.49 million VND to 1.6 million VND in 2021 at the 10th session, 14th National Assembly. These teachers and officials receive an allowance of 372,500 VND per session consisting of 04 hours.

Thus, from December 25, 2020 (the effective date of Decree 133/2020/ND-CP), teachers, officials, and soldiers teaching culture, law education, citizenship education, law dissemination, and popularization to inmates will receive an allowance of 0.25 of the statutory pay rate per session consisting of 04 teaching hours, equivalent to 372,500 VND per session according to the current statutory pay rate. Additionally, officials directly involved in education, teaching culture, law education, and citizenship education at inmate detention facilities with outstanding achievements will be honored and awarded the State's honorary titles according to the law.
