Penalties for terrorism-related crimes under the Penal Code in Vietnam

According to the Penal Code 2015 (amended in 2017), there are 3 crimes related to terrorism, including: Terrorism aimed to oppose the people's authority (Article 113), the crime of terrorism (Article 299) and the crime of terrorism financing (Article 300).

Penalties for these three crimes in Vietnam are as follows:

Penalties for terrorism aimed to oppose the people's authority in Vietnam

Pursuant to the provisions of Article 113 of the Penal Code 2015 and Clause 21 of Article 1 of the Law on amendments to Penal Code 2017, those who commit terrorism aimed to oppose the people's authority will be subject to the following penalties:

- Any person who, for the purpose of opposing the people's government, infringes upon life of officials or other people or destroy property of another organization or individual shall face a penalty of 12 - 20 years' imprisonment, life imprisonment, or death.

- This offence committed in any of the following manners carries a penalty of 10 - 15 years' imprisonment:

+ Establishing, joining a terrorist organization or an organization sponsoring terrorism;

+ Forcing, persuading other people to participate in terrorism; recruiting, training terrorists; manufacturing, providing weapons for terrorists;

+ Infringing upon bodily integrity, health of officials or other people; appropriating or damaging property of another organization or individual;

+ Attacking, violating, obstructing, disrupting the computer network, telecommunications network or electronic devices of another organization or individual.

- The act of threatening to commit any of the acts specified in Clause 1 of this Article or intimidating another person carries a penalty of 05 - 10 years' imprisonment.

- Any person who makes preparation for the commission of this criminal offence shall face a penalty of 01 - 05 years' imprisonment.

Terrorist acts against foreign organizations, individuals or international organizations for the purpose of destroying the Vietnam's international relationship also carry the penalties specified above

Penalties for terrorism in Vietnam

Pursuant to the provisions of Article 299 of the Penal Code 2015 and Clause 101 of Article 1 of the Law on amendments to Penal Code 2017, penalties for terrorism are as follows:

- Any person who harms other people's life or destroy property of another organization or individual to bring terror to the public shall face a penalty of 10 - 20 years' imprisonment, life imprisonment or death.

- This offence committed in any of the following circumstances carries a penalty of 05 - 15 years' imprisonment:

+ Establishing or participating in a terrorist organization or terrorism-financing organization;

+ Forcing, persuading, recruiting, training terrorists; manufacturing or providing weapons for terrorists;

+ Infringing upon bodily integrity, health or appropriating, damaging property of another organization or individual.

+ Attacking, violating, obstructing, disrupting the computer network, telecommunications network or electronic devices of another organization or individual.

- A person that threatens to commit any of the acts specified in Clause 1 of Article 299 of the Penal Code 2015 or uses other methods to cause mental intimidation shall face a penalty of 02 - 07 years' imprisonment.

- A person that prepares for the commission of this offence shall face a penalty of 01 - 05 years' imprisonment.

- The offender might also have some citizenship rights deprived of, be put under mandatory supervision or prohibition from residence for 01 - 05 years or have all or part of his/her property confiscated.

Penalties for terrorism financing in Vietnam

Pursuant to the provisions of Article 300 of the Penal Code 2015 and Clause 102 of Article 1 of the Law on amendments to Penal Code 2017, the penalties for terrorism financing in Vietnam are as follows:

- Any person who raises or provides money or property in any shape or form to a terrorist or terrorist organization shall face a penalty of 05 - 10 years' imprisonment.

- A person that prepares for the commission of this offence shall face a penalty of 01 - 05 years' imprisonment.

- The offender might also be put under mandatory supervision or prohibition from residence for 01 - 05 years or have all or part of his/her property confiscated.

- Punishments incurred by a corporate legal entity that commits any of the offences specified in this Article:

+ A corporate legal entity that commits this offence in any shape or form to a terrorist or terrorist organization shall be liable to a fine of from VND 7,000,000,000 to VND 15,000,000,000 or has its operation suspended for 06 - 36 months;

+ A corporate legal entity that commits this offence in the circumstance specified in Article 79 of the Penal Code 2015 shall be permanently shut down;

+ The violating corporate legal entity might also be liable to a fine of from VND 1,000,000,000 to VND 5,000,000,000, be banned from operating in certain fields or raising capital for 01 - 03 years.
