The Council of Judges of the Supreme People's Court has drafted a Resolution Guiding the Application of Certain Provisions of the Criminal Code regarding the Offense of Human Trafficking and the Offense of Trafficking in Persons Under 16 Years Old.
Draft Regulations Detailing the Act of Human Trafficking
The draft regulations detailing the act of human trafficking are as follows:
- Using force, threats of force, deception, or other methods to perform one of the following acts:
- Transferring a person to receive money, property, or other material benefits;- Receiving a person to give money, property, or other material benefits;- Transferring a person for another to exploit sexually, force labor, harvest body parts from the victim, or for other inhumane purposes;- Receiving a person to exploit sexually, force labor, harvest body parts from the victim, or for other inhumane purposes;- Recruiting, transporting, or harboring another person to carry out the acts specified in points a, b, c, or d of this clause.
The draft also specifies that other means include cases where the offender uses methods such as: kidnapping, deception, giving the victim sleeping pills, getting them drunk; using anesthetics; poisoning the victim; exploiting the authority, or the victim's vulnerable situation.
