This noteworthy new point is regulated in Decree 133/2020/ND-CP, detailing the implementation of certain provisions of the Law on Criminal Judgment Execution in Vietnam.

In Clause 3, Article 6 of Decree 133/2020/ND-CP, the number of inmates in a prison cell in Vietnam is specified as follows:
- Common prison: Each cell holds no more than 50 inmates;
- Separate prison: Each cell holds no more than 08 inmates;
- Disciplinary prison: Each cell holds no more than 02 disciplined inmates.
Previously, according to the provisions of Decree 117/2011/ND-CP, only the scale of inmate detention in each detention facility was regulated. To be specific:
- Prisons managed by the Ministry of Public Security housed from 2,000 to 5,000 inmates. Each detention facility could establish several sub-units, each managing up to 1,000 inmates.
- The scale of inmate detention in prisons managed by the Ministry of National Defense was up to 500 inmates.
However, effective from December 25, 2020, which is the effective date of Decree 133/2020/ND-CP replacing Decree 117/2011/ND-CP, specific regulations have been provided regarding the maximum number of inmates in each prison cell within the detention facility.
Additionally, the Decree clearly stipulates the organizational structure of the prison management apparatus. Specifically:
- The organizational structure of the prison management apparatus includes the Warden, Deputy Warden, Head of Sub-unit, Deputy Head of Sub-unit, Team Leader, Deputy Team Leader; officers, professional soldiers, non-commissioned officers; soldiers and workers of the Public Security, Defense workers.
- The Warden, Deputy Warden, Head of Sub-unit, Deputy Head of Sub-unit, Team Leader, Deputy Team Leader must have at least a university degree in police or security or a bachelor's degree in law and meet other standards as prescribed by the Ministry of Public Security and the Ministry of National Defense.
These are two noteworthy new points of Decree 133/2020/ND-CP, which have strictly regulated the organization of prisons and the organizational structure of the prison management apparatus to ensure strict management of inmates.
