Detailed Dossier for Requesting Conditional Early Release

Joint Circular 04/2018/TTLT-BCA-BQP-TANDTC-VKSNDTC stipulates that the dossier proposing conditional early release includes the documents specified in Clauses 1 and 2, Article 368 of the 2015 Criminal Procedure Code, including:

  1. Application for early release from prison with conditions attached, accompanied by a commitment not to violate the law and the obligations to be fulfilled when being conditionally released early;
  2. Copy of the judgment, Decision of the Court with legal effect; Execution Decision;
  3. Copy of the Decision reducing the duration of serving a prison sentence for serious, very serious, and particularly serious crimes;
  4. Decision or copy of the Decision classifying the serving of a prison sentence;
  5. Documents to determine the actual time served of the prison sentence including the judgment, the Court's legal decision, and the Execution Decision;
  6. Written proposal for early release with conditions from the detention facility;
  7. Receipts, vouchers, invoices, etc. showing completion of additional punishment in the form of fines, compensation for damages, and court fees.

In addition to the above documents, in the case of inmates who are people with meritorious services to the revolution, relatives of people with meritorious services to the revolution, people 70 years old or older, people with severe or particularly severe disabilities, women raising children under 36 months old, and those serving prison sentences under 18 months old, one of the following supporting documents is required:

- Offenders who have relatives with meritorious services to the revolution must have a confirmation certificate or a copy of documents proving this, certified by the Commune People's Committee where they reside or by their work unit; if they are adopted children, they must have a Decision dated before the individual committed the crime;- Copy of the Birth Certificate or excerpt from the judgment determining the inmate is 70 years old or older or an inmate under 18 years old;- Copy of the Birth Certificate or Birth Certificate Extract determining the female inmate has a child under 36 months old;- Disability certification identifying the inmate as having severe or particularly severe disabilities.
