Law No. 12/2017/QH14 amends the 2015 Penal Code to add two crimes (Embezzlement and Bribery) that are not subject to statutory limitations for enforcement of judgments starting from January 1, 2018.

To be specific: Amend and supplement Article 61 of the 2015 Penal Code as follows:
The statute of limitations for the enforcement of judgments shall not apply to offenses stipulated in Chapter XIII, Chapter XXVI, Clause 3 and Clause 4 of Article 353, Clause 3 and Clause 4 of Article 354 of the 2015 Penal Code.
Chapter XIII - Crimes infringing upon national security;
Chapter XXVI - Crimes of undermining peace, against humanity, and war crimes;
Clause 3 and Clause 4 of Article 353 - Offense of embezzlement of property:
- Any person who commits any of the following offenses shall be liable to a sentence of imprisonment from 15 to 20 years:
a) Embezzles property valued from 500,000,000 VND to less than 1,000,000,000 VND;
b) Causes property damage from 3,000,000,000 VND to less than 5,000,000,000 VND;
c) Adversely affects security, order, and social safety;
d) Leads to the bankruptcy or cessation of business operations of enterprises or other organizations.
- Any person who commits any of the following offenses shall be liable to a sentence of imprisonment of 20 years, life imprisonment, or the death penalty:
a) Embezzles property valued at 1,000,000,000 VND or more;
b) Causes property damage of 5,000,000,000 VND or more.
- Clause 3 and Clause 4 of Article 354 - Offense of accepting bribes:
- Any person who commits any of the following offenses shall be liable to a sentence of imprisonment from 15 to 20 years:
a) The bribe is money, property, or other material benefits valued from 500,000,000 VND to less than 1,000,000,000 VND;
b) Causes property damage from 3,000,000,000 VND to less than 5,000,000,000 VND.
- Any person who commits any of the following offenses shall be liable to a sentence of imprisonment of 20 years, life imprisonment, or the death penalty:
a) The bribe is money, property, or other material benefits valued at 1,000,000,000 VND or more;
b) Causes property damage of 5,000,000,000 VND or more.
