This is a proposal from the Ministry of Public Security, the Ministry of National Defense, the Supreme People's Court, and the Chief Procurator of the Supreme People's Procuracy in the Draft Interministerial Circular on the coordination in implementing conditional early release according to the provisions of the Criminal Procedure Code 2015.
On April 4, 2018, the Supreme People's Procuracy issued Notification 96/TB-VKSTC regarding the recruitment of 215 officials for procuratorial operations for the entire sector. The detailed content is as follows:
On December 6, the Supreme People's Court of Vietnam held a nationwide online conference to provide training in application of the 2015 Criminal Code, as amended and supplemented in 2017, covering five specific topics and publicly disclosed the conference materials on the Supreme People's Court of Vietnam.
The Law on Custody and Temporary Detention 2015 was promulgated to overcome difficulties and obstacles in the current management of custody and temporary detention; to address the scattered and limited effectiveness of the regulations on the management of custody and temporary detention. Specifically, it includes detailed provisions on policies for custody and temporary detention for minors.
During the adjudication process and law enforcement, due to a lack of evidence and procedural errors, wrongful convictions are inevitable. Some wrongful cases have lasted for decades, such as the "10-year wrongful conviction of Nguyen Thanh Chan" and the shocking case of "Huynh Van Nen – the wrongful conviction of the cashew garden," where the wrongful conviction lasted for 17 years, considered the "pinnacle" of wrongful convictions in Vietnam.
From January 1, 2018, the 2015 Penal Code (amended and supplemented by Law No. 12/2017/QH14) officially takes effect. Accordingly, the application of the provisions in this Code is implemented as guided by Resolution 41 as follows:
The Rape in Article 141 of the Criminal Code 2015 is one of the Articles amended and supplemented according to the Law on Amendments to the Criminal Code 2017 of Vietnam.
The Council of Judges of the Supreme People's Court has drafted a Resolution Guiding the Application of Certain Provisions of the Criminal Code regarding the Offense of Human Trafficking and the Offense of Trafficking in Persons Under 16 Years Old.
This is a new regulation proposed in the Draft Joint Circular currently being consulted by the Ministry of Public Security - the Supreme People's Procuracy - the Supreme People's Court - the Ministry of National Defense, with the main content regarding the procedures, sequence, duration, and location where the accused (or the legal representative of a legal entity) can read and transcribe copies of documents or digitized documents related to the prosecution, defense, or other relevant documents related to the defense.
