1. What is the Vietnam Bar Association?
According to the Charter issued together with Decision 770/QD-TTg dated June 5, 2020, the Vietnam Bar Association is a unified, unified and voluntary political - social - professional organization of jurists throughout the country, is a member of the Vietnam Fatherland Front, under the leadership of the Communist Party of Vietnam, under the management of the State of the Socialist Republic of Vietnam.
2. Tasks of the Vietnam Bar Association
The tasks of the Vietnam Bar Association according to Article 5 of the Charter issued together with Decision 770/QD-TTg dated June 5, 2020 are as follows:
- Complying with the Party's viewpoints and guidelines, the State's policies and laws, and the Association's Charter.
- Gathering, uniting, and promoting the roles of members; organizing and coordinating activities among members in accordance with the principles and purposes of the Association, building the Association strong politically, ideologically, organizationally, and professionally.
- Participating in the formulation of policies, laws, and legal scientific research; participating in social criticism and supervision; and participating in complaint and dispute settlement at the request of state agencies.
- Participating in law dissemination and education, raising legal awareness for members, officials, civil servants, public employees, and the people.
- Legal advice, legal aid, grassroots conciliation, complaint settlement advice, and legal dispute settlement outside the state mechanism in accordance with the law.
- Developing and implementing programs and projects on law dissemination, education, and legal aid in line with the Party and State's socialization policy and other programs and projects at the request of state agencies.
- Participating in training and retraining; selecting a number of judicial and people's juror titles; participating in administrative reform activities, judicial reform activities, crime prevention and combat activities, and other judicial activities as prescribed by law.
- Coordinating with relevant agencies and organizations to perform the Association's tasks and fulfill the obligations of members of the Vietnam Fatherland Front.
- Promoting international cooperation activities, expand and improve the efficiency of cooperation activities between the Vietnam Bar Association and progressive organizations and jurists of countries in the region and the world in accordance with the provisions of law; mobilizing jurists who are overseas Vietnamese to unite and contribute to national construction.
Participating in people-to-people diplomacy in accordance with the Party's guidelines and policies and the State's laws.
- Publishing and distributing books, magazines, and other legal publications to meet the requirements of the Association's operation in accordance with the law.
- Developing and implementing the code of ethics for members of the Vietnam Bar Association in accordance with the law and the Association's Charter.
- Managing and using the Association's assets and finances in accordance with the law and the Association's Charter.
- Performing other duties when required by competent authorities.
3. Powers of the Vietnam Bar Association
According to Article 6 of the Charter issued together with Decision 770/QD-TTg dated June 5, 2020, the powers of the Vietnam Bar Association include:
- Widely propagating the principles, purposes, and tasks of the Association.
- Representing members in internal and external relationships related to the functions and tasks of the Association; making recommendations to competent state agencies on issues related to the development of the Association and its field of operation; on law-making and enforcement; and on other related issues.
- Reflecting the thoughts and aspirations of Vietnamese jurists with the Party and State; training, fostering, and improving legal knowledge and professional ethics for members; encouraging morale and showing concern for members' interests;
Protect members' legitimate rights and interests; settle complaints and denunciations of members in accordance with the law and the Association's Charter.
- Providing services on issues in the field of the activities of the Association in accordance with the law.
- Establishing organizations and units under the Association in accordance with the law and the Association's Charter.
- Raising funds for the Association on the basis of membership fees and other lawful revenue sources as prescribed by law.
- Receiving legal funding sources from organizations and individuals at home and abroad according to the provisions of law.
- Joining the respective international organizations and signing and implementing international agreements in accordance with the law.
