1. Having a Full Name Is a Basic Personal Right in Vietnam

According to Article 25 of the Civil Code, the right to personal identity is a civil right attached to each individual and cannot be transferred to another person. Information such as the full name or other personal details like gender, date of birth, place of residence, etc., are all part of the personal identity rights of each individual.

2. Do Not Choose Names That Infringe on Others

According to Clause 3, Article 26 of the 2015 Civil Code, naming is restricted in cases where it infringes upon the legal rights and interests of others or contravenes the fundamental principles of civil law in Vietnam.

However, this provision is still general and broad, and there is no specific guidance on what constitutes a name that infringes upon the legal rights and interests of others or violates the basic principles of civil law.

3. Child's Name Must Be in Vietnamese and Should Not Contain Special Characters

According to Clause 3, Article 26 of the 2015 Civil Code, the name of a Vietnamese citizen must be in Vietnamese or another Vietnamese ethnic language; names cannot be in numbers or characters that are not letters.

This is a new regulation compared to all previous Civil Codes, marking the first time that names must be in Vietnamese and cannot include numbers or non-alphabet characters. This regulation is progressive and suitable for achieving consistency in the national population database system and simplifying civil status management. Naming in foreign languages, numbers, or special characters has previously caused significant difficulties for state management agencies and those individuals bearing such names.

4. Child's Name Must Not Be Too Long

According to Clause 1, Article 6 of the Circular 04/2020/TT-BTP by the Ministry of Justice, which stipulates detailed provisions for the implementation of the Law on Civil Status and Decree 123/2015/ND-CP, the determination of surname, ethnicity, and naming for children must comply with the law while preserving ethnic identity, customs, and the fine cultural traditions of Vietnam; names must not be excessively long or difficult to use.
