Vietnam: Spreading fake news about storms and floods in the Central region can result in a fine of up to VND 20 million

The storm and flood situation in the Central region is very tense, but some people on social networks have taken advantage of storm and flood news to attract views and likes, causing confusion among people.

According to Point a Clause 1 Article 101 of Decree No. 15/2020/NĐ-CP of Vietnam’s Government, a fine ranging from VND 10,000,000 to VND 20,000,000 shall be imposed for the commission of one of the following violations:

a) Providing/sharing fake or false information with the aims of distorting, slandering or damaging the prestige, honor and dignity of other organizations, authorities or individuals;

As well as fines for spreading false rumors about the Covid-19 epidemic, spreading fake news about storms and floods in the current situation is also very condemnable. For this behavior, the average fine will be VND 15 million, however if aggravating circumstances are found, the fine can be up to VND 20 million.

In addition to the fines for spreading fake news about storms and floods in the Central region mentioned above, Decree No. 104/2017/NĐ-CP of Vietnam’s Government also provides a number of fines related to the current natural disaster situation, in particular:

- A fine ranging from VND 100,000 to VND 300,000 shall be imposed for deliberately delaying or failing to follow directions or orders for disaster relief from an authorized authority or person.

- A fine ranging from VND 3,000,000 to VND 5,000,000 shall be imposed for opposing or obstructing the implementation of directions or orders for disaster relief or decisions on mobilization of human and material resources, vehicles and other necessities, etc. to serve an emergency response made by authorized authorities or persons.

- A fine ranging from VND 15,000,000 to VND 25,000,000 shall be imposed for deliberately keeping secret of information or providing false information about locations and status of ships, boats or vessels that are operating at sea, river or lake for local governments or competent authorities when disaster occurs.

- A fine ranging from VND 5,000,000 to VND 10,000,000 shall be imposed for failure to give aid or provide information for rescue forces to search for and give aid to persons or boats, ships or vessels that face perils at sea, river, stream or lake.

- A fine ranging from VND 20,000,000 to VND 40,000,000 shall be imposed for requesting for an emergency medical service but failing to cooperate with the rescue team causing waste of time and resources of the rescue forces.

- A fine ranging from VND 5,000,000 to VND 10,000,000 shall be imposed for misusing or causing loss of relief or improperly providing relief.

Above are some administrative fines in the field of natural disasters, everyone should understand clearly to avoid violations, and at the same time help government agencies perform well the task of rescue in the current situation.
