1. What is the guarantee of a copy of a certificate from the master register?

According to Clause 1, Article 18 of Circular 63/2022/TT-BQP, the issuance of a copy of a certificate from the original number means that the agency managing the master register issues a certificate based on the information recorded in the book to issue a copy.

In which case, the content recorded in the copy of the certificate from the master register must be exactly the same as that of the master register.

In the event that the certificate copy template at the time of issuance has changed, the agency managing the master register shall use the current certificate copy template to issue a copy of the certificate.

(Clause 1, Article 18 of Circular 63/2022/TT-BQP).

2. Eligibility to request a copy of the certificate from the master register in Vietnam

Specifically, in Article 21 of Circular 63/2022/TT-BQP, those who have the right to request a copy of a certificate from the master register include:

(i) The holder of the original certificate

(ii) The original certificate holder's legal representative or authorized representative

(iii) The original certificate holder's father, mother, child, wife, husband, brother, sister, brother, and other heirs if such person has died. 

3. Procedures for issuing a copy of a certificate from the master register in Vietnam

3.1. Application for a copy of the certificate from the master register in Vietnam

An application for a copy of a certificate from the master register is specified in Clause 1, Article 22 of Circular 63/2022/TT-BQP, specifically as follows:

(1) An application for a certified copy of a certificate must be made according to the form specified in Appendix IV to Circular 63/2022/TT-BQP, which contains information about the certificate already issued.

(2) original or certified true copy of officer ID card, professional military ID card, identity card, citizen identification card, valid passport, or other lawful identification document with photo of certificate holder for examination by the person receiving the dossier.

(3) If the person named in (ii) requests a copy of the certificate from the master register, he or she must present a power of attorney (for the authorized person) or documents proving the person's relationship with the original certificate holder.

(4) If the requester for a copy of the certificate from the master register sends the request by post, he/she must send a certified copy of the document specified in (1), (2), (3), enclosed with a stamped envelope clearly stating the recipient's full name and address to the agency competent to issue a copy of the certificate from the master register.

3.2. Procedures for issuing a copy of the certificate from the master register in Vietnam

The order to issue a certificate from the master register is specified in Clause 2, Article 22 of Circular 63/2022/TT-BQP, specifically as follows:

- The applicant for issuance of a copy of the certificate shall submit one set of documents directly or by post as prescribed in Section 3.1 to the agency competent to issue a copy of the certificate from the master register.

- Right on the day of receiving the request for issuance of a copy or the next working day, the agency competent to issue a copy of the certificate from the master register must issue a copy to the requester.

In the event that the request for issuance of copies from the master register is sent by post, the time limit shall be determined from the time when the agency receiving the request for issuance of copies receives complete and valid dossiers according to the arrival postmark.

- In case the certificate content is complicated and difficult to check and compare, but the agency receiving the request for issuance of a copy cannot meet the time limit prescribed by regulations, the time limit for grant of a copy is extended no more than 3 working days.

At that time, the agency competent to issue a copy of the certificate shall rely on the certificate-granting master register to issue a copy, and the copy's contents must conform to the contents recorded in the master register.

In the event that the master register is no longer able to be stored or there is no information on the content of the request for issuance of a copy or the requester does not issue a copy to the requester, the agency that receives the request for issuance of a copy shall reply in writing and clearly state the reason as prescribed at Point b, Clause 2, Article 22 of Circular 63/2022/TT-BQP.
