This is a notable content in the Draft Decree on penalties for administrative violations against medical laws, which is expected to replace Decree No. 176/2013/ND-CP of Vietnam’s Government and currently collecting comments.
Specifically, according to Clause 1 Article 98 of this Draft, any of the following violations shall carry a warning or fine of from VND 300,000 to VND 500,000:
a) Failure to provide complementary birth control instruments for eligible individuals as prescribed by law;
b) Verbally or physically offending the people that practice birth control or the people that have only boys or only girls.
Thus, if this content in the Draft is approved, in the near future, anyone who taunts, sarcasms, or has insulting words or actions against people that have only boys or only girls will be fined up to VND 500,000 (currently, according to Decree No. 176/2013/ND-CP of Vietnam’s Government, the maximum fine for this act is only VND 300,000).
Moreover, inheriting the regulation of Decree No. 176/2013/ND-CP, the Draft also clearly states that a fine of from VND 1,000,000 to VND 2,000,000 shall be imposed for intimidating another person into using contraception.
Concurrently, any of the following violations shall carry a fine of from 3,000,000 VND to 5,000,000 VND:
- Intimidating another person into using or stopping using contraception;
- Intimidating another person to conceive or give birth while the person has only boys or only girls;
A fine of from 5,000,000 VND to 7,000,000 VND shall be imposed for the use of force to compel another person to use contraception.
