Vietnam: Not wearing masks in public places to prevent Covid-19 will be fined up to 3 million VND

From November 15, 2020, the Decree No. 117/2020/NĐ-CP of Vietnam’s Government will officially take effect. According to this new Decree, the act of not wearing a mask in public places to prevent Covid-19 will be fined 10 times more than before.

Specifically, according to Point a Clause 1 Article 12 of Decree No. 117/2020/NĐ-CP of Vietnam’s Government on fines for violations against regulations on epidemic management measures, in which, a fine ranging from VND 1.000.000 to VND 3.000.000 shall be imposed for commission of one of the following violations:

a) Failing to adopt personal protective measures by persons participating in epidemic management and susceptible persons according to guidance of health agencies;

Previously, according to Point a Clause 1 Article 11 of the Decree No. 176/2013/NĐ-CP of Vietnam’s Government, a fine ranging from VND 100,000 to VND 300,000 shall be imposed for failing to provide personal protective equipment for the participants in epidemic prevention and the people at risk of catching diseases according to instructions of health authorities.

Thus, it can be seen that the fine for failing to adopt personal protective measures by persons participating in epidemic management and susceptible persons has been increased 10 times higher than the previous one.

On the other hand, most recently, the People's Committee of Ho Chi Minh City issued the Official Dispatch No. 3856/UBND-VX directing the strict implementation of the measure of wearing masks when leaving the house, at public places and on public transport. Strengthening inspection and strictly handling violations. According to the Official Dispatch No. 3856/UBND-VX, people in Ho Chi Minh City who do not wear masks when leaving their homes, locations and on public transport will be fined with a fine of VND 2 million, in case of aggravating circumstances, the fine shall be up to VND 3 million from September 28, 2020.

On October 28, 2020, the Hanoi People's Committee also issued the Official Dispatch No. 5151/UBND-KGVX requiring all levels, branches, People's Committees of districts, towns and communes, wards and townships to be absolutely not subjective in all cases, must be serious and highly responsible in implementing epidemic prevention and control measures in the new situation, resolutely preventing the spread of epidemics in the community and strictly implement solutions, mandatory wearing of masks on public transport, in public places and strictly handle violations in the prevention and control of Covid-19.

It can be seen that currently our country is very good at preventing Covid-19 so that people are no longer highly alert to the Covid-19 epidemic and are still subjective about the disease, especially often not wearing masks in public places such as in apartment buildings, markets, supermarkets, etc. Therefore, this fine shall help people comply with the local requirement to wear masks to protect themselves and everyone around to avoid the spread of Covid-19 in the community.

Besides, Decree No. 117/2020/NĐ-CP also increases the fine to 5 times for concealing the status of infection with an infectious disease declared as an epidemic of oneself or another person; failing to implement or refusing to implement cleaning, disinfection and sterilization measures in an epidemic zone; failing to participate in epidemic management activities according to a mobilization decision issued by the steering committee for epidemic management; charging for the provision of medical examination and treatment services to persons infected with group A infectious diseases, specifically the fines shall be from VND 5.000.000 to VND 10.000.000.
