The National Assembly of Vietnam adopts the Resolution on the Law and Ordinance-Making Program

Meeting in a plenary session at the National Assembly Building of Vietnam on the morning of June 2, the National Assembly of Vietnam voted to adopt the Resolution on the Law and Ordinance-Making Program for 2024 and the adjustment of the Law and Ordinance-Making Program for 2023, with 446 out of 465 delegates participating in favor of the vote.

Under the Resolution, since the beginning of the 15th National Assembly term until now, despite many difficulties due to the impact of the COVID-19 pandemic and the complex, unpredictable developments of the global and regional situation, many new issues have arisen, the National Assembly of Vietnam, the Standing Committee of the National Assembly of Vietnam, the Government of Vietnam, and relevant agencies and organizations have strived to overcome difficulties and challenges, seriously implemented Conclusion No. 19-KL/TW of the Politburo on the orientation of the Law-building Program for the 15th National Assembly term and legislative tasks according to Plan No. 81/KH-UBTVQH15 of the Standing Committee of the National Assembly of Vietnam, achieving many positive results.

The law-making continues to have many innovations, creativity, practicality, effectiveness, promoting democracy, increasing the rule of law, focusing on responsibility with a proactive legislative spirit, engaging early and extensively. A large number of laws, ordinances, and resolutions have been submitted to the National Assembly and the Standing Committee of the National Assembly for consideration and approval, completing the entire proposed legislative program, ensuring the requirements on progress and quality.

The positive results achieved in legislative work have significantly contributed to the comprehensive and synchronized development of the development institutions, ensuring human rights, citizens' rights, effectively serving the requirements of socio-economic development, ensuring national defense, security, international integration, and continuing to build and perfect the socialist rule of law state of Vietnam.

However, in the work of planning and implementing the law and ordinance building program, there are still some existing limitations that need to be promptly addressed to further improve the quality and effectiveness of law-making in the coming time.

Regarding the adjustment of the Law and Ordinance-Making Program for 2023, the Resolution supplements the Law and Ordinance-Making Program for 2023 as follows: Submit to the National Assembly for comments at the 5th session (May 2023), passing at the 6th session (October 2023) the draft Law on Participation in the Protection of Security and Order at the Grassroots Level.

Submit to the National Assembly for comments at the 6th session (October 2023) the following draft laws: the Law on National Defense and Security Industry and Industrial Mobilization; the Road Law; the Law on Road Traffic Order and Safety; the Capital Law (amended); the Law on Organization of People's Courts (amended); the Law amending and supplementing a number of articles of the Law on Asset Auction.

Submit to the Standing Committee of the National Assembly for comments and approval the draft Ordinance on Procedural Costs.

Regarding the Law and Ordinance-Making Program for 2024. The Resolution resolves that at the 7th session (May 2024), the National Assembly will pass 9 laws, 1 resolution, including: the Law on Social Insurance (amended); the Law on Archives (amended); the Law on National Defense and Security Industry and Industrial Mobilization; the Road Law; the Law on Road Traffic Order and Safety; the Capital Law (amended); the Law on Organization of People's Courts (amended); the Law amending and supplementing a number of articles of the Law on Guard Forces (according to the process at one session); the Law amending and supplementing a number of articles of the Law on Asset Auction and the Resolution of the National Assembly on the Law and Ordinance-Making Program for 2025, adjusting the Law and Ordinance-Making Program for 2024.

At the same time, submit to the National Assembly for comments on 9 draft laws, including: the Law on Notary (amended); the Law on Trade Unions (amended); the Law on Cultural Heritage (amended); the Law on Geology and Minerals; the Law on Civil Defense; the Law on Urban and Rural Planning; the Juvenile Justice Law; the Law amending and supplementing a number of articles of the Law on Pharmacy; the Law amending and supplementing a number of articles of the Law on Standards and Technical Regulations.

At the 8th meeting (October 2024), submit to the National Assembly for approval 9 laws: the Law on Notary (amended); the Law on Trade Unions (amended); the Law on Cultural Heritage (amended); the Law on Geology and Minerals; the Law on Civil Defense; the Law on Urban and Rural Planning; the Juvenile Justice Law; the Law amending and supplementing a number of articles of the Law on Pharmacy; the Law amending and supplementing a number of articles of the Law on Standards and Technical Regulations.

At the same time, submit to the National Assembly for comments on 2 draft laws: the Law on Gender Transition and the Law on Employment (amended).

The Resolution requires the Standing Committee of the National Assembly, the Government of Vietnam, relevant agencies, organizations, and individuals involved in the law-building process to uphold responsibility, strengthen discipline, ensure the implementation of the law and ordinance building program; not to propose adding projects to the program at times close to National Assembly sessions, except in cases of real necessity, urgency, need to promptly implement the policies of the Communist Party, conclusions, directives of the Politburo, Secretariat; thoroughly overcome the situation of submitting projects, drafts not on time as prescribed.

In case of necessity, the Standing Committee of the National Assembly will report to the National Assembly to consider organizing more sessions or extending the regular meeting time of the National Assembly, dividing the session into phases to review, give opinions, and approve many laws and resolutions meeting practical requirements.

Agencies, organizations, and individuals assigned to lead drafting will seriously and substantially summarize the implementation of laws, assess the impact of policies, gather and incorporate opinions from agencies, organizations, individuals, and affected subjects, ensuring practicality and effectiveness.

Drafting must place high quality requirements, closely follow and promptly institutionalize the guidelines and paths of the Communist Party, meet practical requirements; comply with the requirements in Conclusion No. 19-KL/TW of the Politburo and principles of building and promulgating normative legal documents. Thoroughly review related documents to detect and handle inconsistent regulations; ensure there are no conflicts, overlaps, loopholes that can lead to corruption, negativity, embedded "group interests," "local interests" in policy proposals, law construction, and promulgation.
