1. What is the Anti-Smuggling Investigation Department?

According to Article 1 of Decision 1399/QD-BTC dated June 20, 2016, the Anti-smuggling and Investigation Department is a unit directly under the General Department of Customs, with the function of advising and assisting the General Director of Customs in managing, guiding, directing, and inspecting units in the customs sector and organizing the prevention and combat of smuggling and illegal cross-border goods transportation;

Drug Prevention; enforce the protection of intellectual property rights; combat counterfeiting in the field of customs; collect and process information on customs control operations within the scope of their assigned tasks and powers; and in accordance with the law.

In addition, the Anti-Smuggling and Investigation Department has legal status, its own seal, and is allowed to open accounts at the State Treasury and banks in accordance with the law.

2. Tasks and powers of the Anti-Smuggling Investigation Department in Vietnam

Tasks and powers of the Anti-Smuggling Investigation Department according to Article 2 of Decision 1399/QD-BTC dated June 20, 2016 are as follows:

- Submit to the General Director of Customs for submission to the Minister of Finance of Vietnam:

+ Legal documents on professional measures of customs control; the work of preventing and combating smuggling and illegal cross-border transportation of goods; Drug Prevention;

Protection of intellectual property rights; anti-counterfeiting goods in the field of customs; the collection and processing of information on customs control operations and the investigation in accordance with the criminal procedure order under the jurisdiction of the customs authority;

+ Long-term schemes, programs, and plans for preventing and combating smuggling and illegal cross-border transportation of goods; drug prevention; intellectual property rights protection; anti-counterfeiting goods in customs; data collection and processing on customs control operations;

+ Propose and recommend to competent authorities that legal documents related to their assigned management domains be amended, supplemented, or added.

- Submit to the General Director of Customs for promulgation procedures, regulations, and plans on the implementation of professional customs control measures; the work of preventing and combating smuggling and illegal cross-border transportation of goods;

Drug Prevention; protection of intellectual property rights, anti-counterfeiting goods in the field of customs and the collection and processing of information on customs control operations; The investigation work according to the criminal procedure order falls under the competence of the customs authorities.

- Organize implementation:

+ Guide, direct, and inspect the Customs Departments of provinces, inter-provinces, and cities in performing the task of preventing and combating smuggling and illegal cross-border transportation of goods; Drug Prevention;

Protection of intellectual property rights; anti-counterfeiting goods in the field of customs; the collection and processing of information on customs control operations and the investigation in accordance with the criminal procedure order under the jurisdiction of the customs authority;

+ Collect and process information from public and secret sources at home and abroad related to customs control activities; build and manage a database of information on customs control operations;

The focal point of the General Department of Customs in international cooperation is to exchange information on customs control operations with regional and world customs intelligence organizations, customs of other countries, and international organizations;

+ Organize the implementation of professional customs control measures in accordance with the law in order to prevent, detect, stop, investigate, and handle smuggling, illegal transportation of goods, and counterfeit goods.

Prevent and combat drug and other acts that violate customs law; handle administrative violations or initiate criminal proceedings or investigate in accordance with the legal order of criminal procedures;

+ Organize the connection, reception, and exploitation of information and data from the online professional information system to serve the prevention and combat of smuggling, commercial fraud, and the Director of the General Department of Customs' directing and controlling activities;

+ Perform the task of acting as the focal point to advise and assist the Minister of Finance and the Director of the General Department of Customs in performing the duties of a member of the National Steering Committee against smuggling, commercial fraud, and counterfeiting;

And the tasks assigned to the finance sector by the National Steering Committee against Smuggling, Trade Fraud, and Counterfeit Goods in the field of customs control;

+ Organize propaganda and the dissemination of policies and laws on the prevention and combat of smuggling, trade fraud, and illegal cross-border transportation of goods; preventing and combating counterfeit goods and protecting intellectual property rights in customs; drug prevention; prevention and combat of money laundering and terrorism in customs;

+ Implement decisions on the enforcement of tax administrative decisions according to the provisions of law and as assigned by the Director of the General Department of Customs;

+ Organize the control of anti-counterfeiting and protection of intellectual property rights in the field of customs;

+ Carry out the work of preventing and combating money laundering and terrorism in the field of customs;

+ Synthesize, analyze, forecast, warn, and provide information to assist in the formulation of laws, regimes, policies, management, and professional guidance; provide information to relevant organizations in accordance with the law;

+ Guide and explain professional activities within the scope of assigned functions and tasks in accordance with the law;

+ Coordinate the proposal of civil servants and professional technical means, weapons, support tools, and sniffer dogs for the customs control force.

- Carry out training and retraining in professional fields as assigned by the Director of the General Department of Customs.

- Organize scientific research and the application of modern technology in the assigned field according to the provisions of law.

- Implement international cooperation within the scope of assigned tasks in accordance with the law and as assigned by the Director of the General Department of Customs.

- Evaluate, summarize, and report on the performance of assigned tasks in accordance with the law.

- Manage civil servants, public employees, employees and finance, assign assets according to the provisions of law, decentralization of management of the Ministry of Finance of Vietnam.

- Organize the storage of records and documents related to the field of management according to the provisions of law and the management decentralization of the Ministry of Finance of Vietnam.

- Perform other tasks as assigned by the General Director of the General Department of Customs and in accordance with the law.
