Recently, the Government of Vietnam issued Decree 99/2020/ND-CP on regulations concerning the handling of administrative violations in the fields of petroleum, gasoline, and gas trading.
Significantly increase penalties for gas stations selling gasoline through barrels, cans, and bottles from October 11
In Article 35 of Decree 99/2020/ND-CP, the penalties for various violations in retail gasoline sales regulations applicable from October 11, 2020, are specified. To be specific:
- A fine ranging from 1,000,000 VND to 3,000,000 VND for the act of not recording or not clearly recording the sales time in the sales area as prescribed. (According to the provisions of Decree 67/2017/ND-CP, the fine was only from 500,000 VND to 1,000,000 VND)
- A fine ranging from 3,000,000 VND to 5,000,000 VND for the act of selling gasoline through mini pumps, hand-crank pumps, barrels, cans, bottles, and other containers except for merchants who are business households, gasoline distributing stations of armed forces (defense, police) in mountainous and highland areas according to the law permitted by the provincial or city People's Committee under central authority to act as gasoline retail agents with scales and equipment appropriate to the business conditions in those areas. (According to the provisions of Decree 67/2017/ND-CP, the fine was only from 2,000,000 VND to 4,000,000 VND)
- A fine ranging from 5,000,000 VND to 10,000,000 VND for not registering the sales time of retail gasoline stations with the competent state management agencies as prescribed. (According to the provisions of Decree 67/2017/ND-CP, the fine was from 6,000,000 VND to 10,000,000 VND)
- A fine ranging from 10,000,000 VND to 20,000,000 VND for one of the following violations (According to the provisions of Decree 67/2017/ND-CP, the fine was from 20,000,000 VND to 40,000,000 VND):
- Reducing the sales time compared to the listed time or the previous sales time without a valid reason or without notifying the competent state management agencies;- Not selling or stopping sales without the written approval of the competent state management agencies or without notifying the competent state management agencies as prescribed;- Reducing the quantity of goods sold compared to the previous time without a valid reason or without notifying the competent state management agencies.
Additionally, for the act of selling gasoline through automatic gasoline pumps or mobile pumps without the permission of the competent authorities, apart from the cases stipulated in Clause 2 of this Article, the fine ranges from 20,000,000 VND to 40,000,000 VND. (Double compared to the provisions of Decree 67/2017/ND-CP, which was only from 10,000,000 VND to 20,000,000 VND).
