1. What is rotation?
According to Clause 11 of the Law on Cadres and Civil Servants 2008, rotate means to assign or appoint a managerial or leading cadre or civil servant to hold another leading or managerial title for a given period in order to further train and retrain him/her in response to task requirements.
2. Subjects and scope of rotation of civil servants holding management positions in Vietnam
The subjects and scope of rotation of civil servants holding management positions according to Article 55 of Decree 138/2020/ND-CP are as follows:
- Subjects of the rotation:
+ Civil servants in management positions in agency and organization planning;
+ Civil servants in top positions who, by law, cannot serve in the same locality or agency for more than two consecutive terms;
+ Civil servants holding management positions who are not allowed to arrange local people according to regulations
- Based on the requirements of tasks, master plans and plans to employ civil servants to lead and manage are rotated in the system of agencies of the Communist Party of Vietnam, the State and political organizations - society.
- Positions are arranged and rotated according to the guidelines of the party and the competent authorities.
3. Standards and conditions for the rotation of civil servants holding management positions in Vietnam
Standards and conditions for the rotation of civil servants holding management positions according to Article 56 of Decree 138/2020/ND-CP are as follows:
- Having a firm political stance, ideology, and good moral character.
- In the planning stage, there is capacity and development potential; always complete the assigned task well.
- Basically meeting the specific criteria and conditions of the position to be transferred
- Age requirements:
+ Still working at least two terms (10 years) after rotation;
+ To implement regulations on not assigning local people and holding more than two consecutive terms in a locality, agency, organization, or unit, the civil servants holding management positions must have at least one working term remaining.
- Being healthy enough to work.
4. Application and time of rotation of the civil servants holding management positions in Vietnam
The application and timing of the rotation of leading and managerial civil servants according to Articles 60 and 61 of Decree 138/2020/ND-CP are as follows:
* Application of civil servants rotated as prescribed for appointment dossiers specified in Article 48 of Decree 138/2020/ND-CP:
- A report on the appointment signed by the agency or organization's head (in the case of submission to a competent superior for an appointment decision) or by the agency's head in charge of the organization and personnel work (in the case of a decision by the agency or organization);
- At each stage of the appointment process, a summary of the vote counting results, as well as the vote counting minutes;
- A curriculum vitae self-declared in the prescribed form, certified by the direct management agency, with a 4x6 color photo taken within the last six months;
- A self-evaluation of the previous three years of work;
- Comments and assessments of collective leadership of agencies and organizations in the last three years on ethical qualities, lifestyle, sense of discipline, internal solidarity, work capacity, performance results, and duties;
- Comments from the branch committee on the location of his and his family's residence.If his or her place of residence is different from that of his or her family, he or she must obtain comments from the branch committee where he or she resides and where his or her family resides;
- Conclusion of the competent committee on political standards;
- A declaration of assets and income according to the prescribed form;
- Copies of diplomas and certificates as required by appointed title standardsIn the event that the employee has a diploma issued by a foreign educational institution, it must be recognized in Vietnam according to regulations;
- Within 6 months, a health certificate issued by a competent medical facility
* For one rotation, the rotation period must be at least three years (36 months). Special cases shall be considered and decided by competent authorities.
