This is a notable content regulated at the Residence Law 2020, approved by the National Assembly of Vietnam on November 13, 2020.
According to Article 22 of the Residence Law 2020 of Vietnam, procedure for permanent residence registration is stipulated as follows:
- The applicant shall submit their application to the registration authority of the locality where they reside.
- Upon receipt of an application, the registration authority shall check and issue an acknowledgement of application receipt to the applicant; and instruct the applicant on how to complete their application if it is incomplete.
- Within 07 working days starting from the date of receipt of an adequate and valid application, the registration authority shall appraise and update information on the new permanent residence of the applicant to the residence database and notify the applicant of such update; and provide a written explanation for the applicant if the application is rejected.
(According to the Residence Law 2006 of Vietnam: “Within fifteen days after the receipt of complete dossiers, the competent agencies defined in Clause 1 of this Article shall grant household registration books to permanent residence registration dossier submitters; in case of refusal to grant, they shall give written replies clearly stating the reasons therefor.”)
- A person who has registered their permanent residence but is moving to another lawful place of residence and is eligible for permanent residence registration shall register their new place of residence as their permanent residence according to regulations of this Law within 12 months starting from the date upon which they become eligible.
Thus, from July 01, 2021, applicants for permanent residence registration will no longer be issued with the household book, instead, information on the new permanent residence of the applicant shall be updated to the residence database and applicant shall be notified of such update. Besides, the processing time for permanent residence registration is also shortened from 15 days to 07 days.
Moreover, according to this Law, failing to receive or postpone receipt of residence registration documents or information or other acts of harassment; failing to process or process a valid application for residence registration in a belated manner; annulling permanent or temporary residence registration against regulations of law are strictly prohibited.
Therefore, if the residence registration agency fails to perform or fails to comply with the time limit for residence registration for citizens when the dossier is eligible for residence registration, it will be penalized according to regulations.
The Residence Law 2020 of Vietnam takes effect from July 01, 2021, replacing the Residence Law 2006.
