Regarding this issue, LawNet would like to answer as follows:
1. Functions, tasks, and organizational structure of the institution of fostering and nursing people with meritorious services
Pursuant to Article 133 of Decree 131/2021/ND-CP, which stipulates the functions, tasks, and organizational structure of establishments for nurturing people with meritorious services, as follows:
- The injury rate in establishments for nurturing people with meritorious services with the function and task of nurturing wounded and sick soldiers is 81% or higher.
- Nursing facilities for people with meritorious services have the functions and tasks of nursing and health rehabilitation for people with meritorious services and their relatives.
- The Ministry of Labor, War Invalids, and Social Affairs of Vietnam shall specify the functions, tasks, and organizational structure of establishments for nurturing and nursing people with meritorious services under its management.
Provincial-level people's committees shall specify the functions, tasks, and organizational structure of establishments for nurturing people with meritorious services under their management.
2. Policies and regimes applicable to establishments raising and nursing people with meritorious services in Vietnam
Policies and regimes applicable to establishments raising and nursing people with meritorious services under Article 134 of Decree 131/2021/ND-CP are as follows:
- In terms of the number of people working at the facility, the Ministry of Labor, War Invalids, and Social Affairs of Vietnam shall assume primary responsibility and collaborate with the Ministry of Home Affairs in submitting regulations to the government.
- In terms of infrastructure: The state budget ensures construction, renovation, upgrading, and repair; maintenance of facilities; and procurement of equipment, means, tools, and instruments for establishments raising and nursing people with meritorious services.
+ Investment projects to build establishments for nurturing and nursing people with meritorious services shall comply with the law on public investment.
+ For projects to renovate, upgrade, repair, and maintain nursing facilities for people with meritorious services to request support from recurrent expenditures from the central budget according to the Ordinance on Incentives for people with meritorious services to the revolution, the dossier must be sent to the Ministry of Labor, War Invalids, and Social Affairs of Vietnam before the time of budget allocation.
Dossier to request financial support for renovation, upgrading, repair, and maintenance projects:
++ For projects on renovating, upgrading, repairing, and maintaining nursing and fostering establishments, welcoming people with meritorious services, and requesting support from recurrent expenditures from the central budget according to the Ordinance on Incentives for People with Meritorious Services to the Revolution, from 500 million VND or more:
Decision approving the project or approving the economic and technical report of the President of the People's Committee of the province or the Director of the Department of Labor, War Invalids, and Social Affairs for establishments nurturing and nursing people with meritorious services managed by the local;
Or by the Minister of Labor, War Invalids, and Social Affairs or the agency authorized by the Ministry of Labor, Invalids, and Social Affairs for approval for establishments raising and nursing people with meritorious services.
under the Ministry of Labor, War Invalids, and Social Affairs of Vietnam, together with documents as a basis for approval according to current regulations.
++ For works with a total investment of less than 500 million VND: decision approving the cost estimate of repair and maintenance for the head of the unit managing the establishment for nurturing and nursing people with meritorious services.
In case the works are damaged due to natural disasters, storms, floods, fires, or other force majeure reasons, there must be a decision approving the repair of the work by the competent authority according to the above provisions, including a full explanation of the content that needs to be repaired and remedied.
++ Nursing and fostering homes for people with meritorious services run by the community: The Department of Labor, War Invalids, and Social Affairs is responsible for making and summarizing the cost estimate for renovation, upgrading, repair, and maintenance into the budget estimate for the implementation of the Ordinance on Incentives for people with meritorious services to the revolution of the locality; synthesizing and sending dossiers and documents promulgated according to its competence to the Ministry of Labor, War Invalids, and Social Affairs of Vietnam.
++ For establishments nurturing and nursing people with meritorious services under the Ministry of Labor, War Invalids, and Social Affairs of Vietnam: The Ministry of Labor, War Invalids, and Social Affairs of Vietnam is responsible for approving or decentralizing approval according to the above provisions and compiling a general estimate to ensure facilities for nurturing and nursing people with meritorious services to the revolution.
+ For funds for the procurement of equipment, means, tools, and instruments for the establishments raising and nursing people with meritorious services come from the recurrent expenditures of the central budget according to the Ordinance on Preferences for People with Meritorious Services to the Revolution, they must be proposed in the annual estimate sent to the Ministry of Labor, War Invalids, and Social Affairs of Vietnam.
For establishments that nurture people with meritorious services managed by the locality: the Department of Labor, War Invalids, and Social Affairs is responsible for making and synthesizing the procurement cost estimate into the cost estimate for the implementation of the Ordinance on Incentives for People with Meritorious Services to the Local Revolution and sending it to theMinistry of Labor, Invalids, and Social Affairs
For establishments nurturing and nursing people with meritorious services under the Ministry of Labor, War Invalids, and Social Affairs of Vietnam: In the annual estimate, the Ministry of Labor, War Invalids, and Social Affairs of Vietnam has the overall responsibility to ensure the facilities for nurturing and nursing people with meritorious services to the revolution.
