Penalty up to VND 30 million for requesting notarization of fake contracts and transactions

On July 15, 2020, the Government of Vietnam issued Decree 82/2020/ND-CP stipulating sanctions for administrative violations in the fields of judicial support; judicial administration; marriage and family; civil judgment enforcement; bankruptcy of enterprises and cooperatives.

From September 1, 2020, the effective date of Decree 82/2020/ND-CP, acts of requesting notarization of sham contracts and transactions will be penalized with fines ranging from 20,000,000 VND to 30,000,000 VND.

In addition, this Decree also stipulates new penalty levels for violations of regulations related to notarization of contracts, transactions, and translations effective from September 1, 2020. Specifically:

- Fine from 7,000,000 VND to 10,000,000 VND for one of the following acts:

- Erasing, altering to falsify the content of documents issued by authorities or competent organizations to notarize contracts, transactions, translations;- Using documents with falsified content issued by authorities or competent organizations to notarize contracts, transactions, translations.

Note: These acts will be subject to additional penalties, which include confiscation of the documents with falsified content.

- Fine from 10,000,000 VND to 15,000,000 VND for one of the following acts:

- Deceptive and dishonest acts during witnessing or translating;- Inaccurate, unsuitable translation of documents.

- Fine from 20,000,000 VND to 30,000,000 VND for one of the following acts:

- Impersonation or hiring another person to impersonate the notary requestor; impersonation or hiring another person to impersonate the party with rights or obligations related to the contract or transaction to notarize the contract or transaction; forging the signature of the notary requestor;- Requesting notarization of sham contracts or transactions;- Providing false information or documentation to notarize contracts, transactions;- Providing false information or documentation to notarize translations;- Obstructing notarization activities.
