Parents Taking Their Children's Tet Lucky Money Can Be Fined Up to 1 Million VND

This is a notable provision mentioned in Decree 167/2013/ND-CP on the regulation of administrative sanctions in the fields of security, order, social safety; prevention and control of social evils; fire prevention and fighting; and combating domestic violence.

To be specific, according to point a, Clause 2, Article 56 of Decree 167/2013/ND-CP, the act of appropriating the private assets of a family member is considered an act of economic violence and will be fined from 500,000 VND to 1,000,000 VND.

According to the provisions of Clause 1, Article 75 of the Law on Marriage and Family 2014: "Children have the right to own private property. Children's private property includes property inherited separately, given separately, income from children's labor, profits, interests arising from children's private property, and other lawful income. Property formed from children's private property is also considered children's private property."

It can be seen that Tet lucky money is also considered children's private property according to this regulation. When children in the family receive Tet lucky money from others and parents ask the children to give the lucky money to them, they may be fined an amount ranging from 500,000 VND to 1,000,000 VND according to point a, Clause 2, Article 56 of Decree 167/2013/ND-CP mentioned above.

However, the act of parents asking children to hand over their lucky money for management is not inherently harmful. Therefore, in this case, parents may discuss and agree with their children on how to reasonably manage and use this lucky money, as stipulated in Article 76 of the Law on Marriage and Family 2014:

*"1. Children aged 15 or older may manage their own private property or ask their parents to manage it.

2. The private property of children under 15 years old or children who lack civil legal capacity is managed by their parents. Parents may authorize another person to manage the children's private property. The private property managed by parents or others must be returned to the children when they reach the age of 15 or when they fully regain their legal capacity, unless there is another agreement between the parents and the children."

Tet Nguyen Dan is a beautiful cultural tradition in our country. Giving lucky money during Tet carries the good intention of wishing the recipient many good things in the new year. Therefore, instead of forcing the children to give them the money for management, parents should guide their children on how to manage and use this lucky money appropriately.
