No transfer of car names through many owners in Vietnam after December 31, 2021

Specifically, in Clause 3, Article 26 of Circular 58/2020 of Vietnam, the settlement of registration of vehicle title transfer in case the vehicle has been transferred ownership through many people is carried out from August 1, 2020 to the end of 31. December 2021.

Therefore, there are only more than 2 months for people who are using vehicles without registration to carry out procedures for vehicle title transfer to ensure their legal rights and interests.

Procedures and documents to transfer the name of a car passed many owners in Vietnam

** In case of transferring the vehicle's name to another province or centrally run city:

Step 1: The person goes to the vehicle registration file management agency to carry out the procedures for transferring the name, presenting the vehicle owner's papers as prescribed in Article 9 of Circular 58/2020, clearly state the legal process of buying, selling, delivering and receiving the vehicle, committing to the vehicle's origin and submitting the following documents:

- Certificate of registration, license plate;

- Vehicle ownership transfer papers of the person named in the vehicle registration certificate and the final seller's vehicle ownership transfer document (if any).

Step 2: After receiving all the required documents, the vehicle registration dossier management agency will issue a certificate of revocation of registration and license plate for the current vehicle user to complete the registration procedures and be issued number plates at the place of residence.

Step 3: Submit the application at the vehicle registration office where you live

Vehicle users go to the vehicle registration dossier management agency in their residence, present the vehicle owner's papers as prescribed and submit the following documents:

- Vehicle registration certificate (according to form No. 01);

- Registration fee documents as prescribed;

- Certificate of revocation of registration, license plate.

Step 4: After receiving all valid documents, the vehicle registration dossier management agency will process registration and issue license plates according to regulations.

** In case of car registration in the same province or centrally run city:

In this case, the vehicle user should carry out the vehicle title transfer procedure concurrently with the vehicle title transfer registration procedure, specifically as follows:

Step 1: The person using the car goes to the vehicle registration file management agency, presents the vehicle owner's papers according to Article 9 of Circular 58/2020 of Vietnam, clearly stating the legal process of buying, selling, delivering and receiving the vehicle, and committing about the origin of the vehicle and submit the following documents:

- Certificate of registration, license plate;

- The vehicle ownership transfer papers of the person named in the vehicle registration certificate and the final seller's vehicle ownership transfer papers (if any);

- Vehicle registration certificate;

- Registration fee documents as prescribed.

Step 2: After receiving all valid documents, the vehicle registration dossier management agency will handle registration and issue license plates according to regulations.

Note:

- In case the current car owner has the vehicle ownership transfer paper of the person named in the vehicle registration certificate and the last seller's vehicle ownership transfer document: Within 02 working days from the date of registration. On the date of receipt of complete and valid dossiers, the vehicle records management agency shall process the registration, issue number plates (for cars transferred in the same province and motorcycles at the same vehicle registration point) or issue a certificate of revocation of registration license, plate number for the person using the vehicle;

- In case the current vehicle user does not have the vehicle ownership transfer papers: The vehicle records management agency shall issue an appointment certificate valid to use the vehicle within 30 days; send a notice to the person named in the vehicle registration, publicly posting it on the website of the Traffic Police Department and at the head office of the agency; Search the stolen vehicle archive and vehicle registration data right after receiving the transfer file.

After 30 days, if there is no dispute or lawsuit, the vehicle records management agency must settle the registration, issue number plates (for transferred cars in the same province and motorcycles at the same vehicle registration point) or issue a certificate of registration. Receive and revoke vehicle registration and license plates for current vehicle users.

- Vehicle ownership transfer papers and vehicle owner papers are specified in Clause 2, Article 8 and Article 9 of Circular 58/2020/TT-BCA of Vietnam respectively.
