New regulation of the Politburo of Vietnam on casting vote of confidence

(Chinhphu.vn) - Standing member of the Secretariat Vo Van Thuong, on behalf of the Politburo, has just signed and promulgated Regulation No. 96-QD/TW regarding the casting vote of confidence for titles and leadership and management positions in the political system.

New    Regulations    from    the    Politburo    on    Confidence    Voting

This regulation replaces Regulation No. 262-QD/TW, dated October 8, 2014, from the Politburo of Vietnam on casting vote of confidence for CPV and State leadership members, Vietnam Fatherland Front, and socio-political organizations.

Vietnamese officials with low confidence shall be promptly removed from planning, resign, or be dismissed

The regulation clearly states the viewpoints and principles: Ensure the leadership of the Communist Party of Vietnam, strictly implement the principles of democratic centralism, self-criticism, and criticism; uphold the responsibility of the CPV committee, CPV organization, agency, unit, head, especially the person subject to the confidence vote, and the person recording the confidence vote.

Perform well in political and ideological work, ensure democracy, objectivity, fairness, publicity, and transparency in taking confidence votes and using the results.

Strictly prohibit and handle violations, distorting confidence levels, or taking advantage of confidence votes to undermine others' reputation, causing internal division and disunity.

casting vote of confidence is an important aspect of evaluating officials, carried out periodically; an official holding multiple positions of leadership and management must conduct casting vote of confidence in a maximum of 2 places where he/she works and lives.

The results of casting vote of confidence must be reported to the competent authorities managing officials and made public according to regulations.

Officials with low confidence must be promptly removed from planning, resign, be dismissed, or reassigned to a lower position than the current one without waiting for the term or appointment period to end.

Subjects of casting vote of confidence in Vietnam

Officials holding leadership and management positions in organizations, agencies, and units within the political system from the central level to the subordinate units.

Officials who have been notified to retire or were appointed/elected in the year of casting vote of confidence do not undergo casting vote of confidence.

The components recording confidence votes are specified for each leadership and management position within the political system (Appendix 1).

A casting vote of confidence meeting can only proceed when at least 2/3 of the summoned individuals are present.

Mid-term casting vote of confidence of CPV Congresses at all levels in Vietnam

casting vote of confidence is carried out periodically in the third year (mid-term year of CPV congresses at all levels). Specifically:

casting vote of confidence for positions elected or approved by the National Assembly, People's Councils of all levels is performed according to the National Assembly regulations.

casting vote of confidence for positions elected by the Central Executive Committee of the Communist Party of Vietnam is carried out under the work program of the Central Executive Committee of the Communist Party of Vietnam.

casting vote of confidence for local CPV leadership positions is conducted after voting on confidence for positions elected by the People's Councils of all levels.

casting vote of confidence for other leadership and management positions is conducted after the preliminary summary of the first 6 months of the third year of the CPV congresses at all levels.

Specifying evaluation criteria

Along with general criteria on political qualities, ethics, lifestyle, organizational discipline awareness of the leadership official, this regulation clarifies criteria related to family and relatives. Specifically:

Position, viewpoint, political bravery in implementing the CPV's guidelines, the State's policies and laws; maintaining political qualities, ethics, lifestyle; responsibility in work, attitude of serving the people; integrity, honesty, fairness, and objectivity in performing assigned tasks.

Awareness of organizational discipline, compliance with the organizational principles and activities of the Communist Party of Vietnam, especially the principles of democratic centralism, self-criticism, and criticism; adherence to organizational assignments; implementation of regulations and rules of CPV committees, CPV organizations, agencies, units where one works; ability to unify, internal unity, and handle complex and sensitive issues.

Leadership and direction results in implementing the CPV's guidelines on combating corruption and negativity, things that CPV members are forbidden to do, and setting an example; exemplary behavior of oneself and spouse, children in complying with the State's policies and laws;maintaining regular contact with the local CPV committee where one resides.

Regarding the results of performing assigned responsibilities and tasks (from the beginning of the term to the time of voting):

Leadership, advising, and organizing the implementation of the CPV's guidelines, the State's policies and laws within the field and scope of responsibility; dynamism, innovation, creativity, decisiveness, daring to think, daring to do, and bearing responsibility in performing assigned tasks.

Quantity, quality of products, effectiveness of performing assigned responsibilities and tasks; level of task completion for affiliated organizations, agencies, units.

Leadership results on organizational work, officials; combating corruption and negativity; inspection and supervision work; handling complaints and denunciations within the field and scope of responsibility.

Three levels of confidence

The regulation requires the vote to clearly state the name, position of the person subject to the confidence vote, and the confidence levels in three tiers: "high confidence," "confidence," and "low confidence."

Based on the vote confidence criteria, the person recording the confidence vote objectively evaluates the person subject to the confidence vote and records their opinion on the confidence vote. The voter can sign or not sign the vote.

The results of the confidence vote for each person are summarized as follows: Name, position of the person subject to the confidence vote; total votes issued; total votes collected, valid votes, invalid votes; total high confidence votes and percentage of total votes collected; total confidence votes and percentage of total votes collected; total low confidence votes and percentage of total votes collected.

Additional names on the confidence vote are invalid

The regulation also clarifies that invalid votes are: Votes not issued by the vote counting committee; votes that strike out the name of the person printed on the vote; votes recording one person but the voter does not mark any box or marks two or three boxes.

If additional names are recorded outside the list of confidence votes, that part is invalid; other cases on the list, if marked according to regulations, are valid.

Three-step confidence vote process

For CPV executive positions and leadership, management positions within the political system:

Step 1: Preparation for casting vote of confidence

Based on the plan of the competent authority, the organizational and personnel advisory agency prepares the following:

- Require the person subject to casting vote of confidence to report according to Clause 3, Article 7 of this regulation.- Compile reports, records of the person subject to casting vote of confidence as per the regulations and explanatory reports, provide relevant information (if any), send to the voter 15 days prior; required details to be clarified by the competent authority or voters must be sent to the person subject to casting vote of confidence 10 days before casting vote of confidence.- Prepare confidence votes listing the persons subject to casting vote of confidence, confidence levels, and affixed with the official seal of the competent CPV committee, CPV organization, agency, or unit as per regulations.- Propose the vote counting committee.

Step 2: Organizing the casting vote of confidence

- The CPV committee, CPV organization, head of the agency, unit presides over the meeting briefing on the purpose, requirement of casting vote of confidence for officials as per regulations.- Elect the vote counting committee; the vote counting committee issues, guides, and collects votes.- Officials in the voting component record and deposit votes into the ballot box as per regulations.

Step 3: Report the casting vote of confidence Results

- The vote counting committee counts votes and announces results in the meeting.- The vote counting record is made in 3 copies (2 copies sent to the direct superior; 1 copy kept at the local, agency, unit) and managed as classified policies.- The CPV committee, CPV organization, agency, unit organizing the casting vote of confidence reports results according to Article 10 of this regulation.

For positions elected or approved by the National Assembly and People's Councils, based on the process specified in Clause 1 of this Article, the Communist Party of Vietnam delegation of the National Assembly leads, specifies, and implements.

Casting vote of confidence results as a basis for planning, moving, appointing, dismissing Vietnamese officials

According to the regulation, casting vote of confidence results are used to evaluate officials, serve as a basis for planning, moving, appointing, introducing officials for candidacy, dismissing, and implementing relevant policies for officials.

In cases where over 50% but less than 2/3 low confidence votes, the authority managing officials removes the official from planning for higher positions; considers relieving current duties, reassignment, or resignation or carrying out a confidence vote as per regulations.

In cases with 2/3 or more low confidence votes, the managing authority dismisses the current position and reassigns (lower) without waiting for the term or appointment period to end.

The regulation also states that for persons subject to casting vote of confidence at 2 places, the comprehensive evaluation of confidence for the official will be decided by the authority based on the overall confidence vote results at each place…/.
