Decree 37/2022/ND-CP amending Decree 96/2020/ND-CP on sanctioning administrative violations in the management and protection of national borders, including increasing the maximum fine for individuals to 75 million VND in Vietnam.

Specifically, the fines and the authority to impose fines in the field of state border management and protection in Vietnam are as follows:
- The maximum fine for individuals in the field of border management and protection in Vietnam is VND 75 million.
(Currently, under Decree 96/2020/ND-CP , the maximum fine is VND 50 million)
- The fine prescribed in Chapter II of Decree 96/2020 shall apply to administrative violations committed by individuals, except for violations specified at Point a, Clause 4, Point a, Clause 5, Point a, Clause 7, Article 6, Point a, Clause 5, Article 7, Point b, Clause 8, Article 8, Point d, Clause 2, Article 9, Article 11 of Decree 96/2020.
In case, organizations commit the same violations in Vietnam as those of individuals, the fine shall be two times the fine imposed on individuals.
- The sanctioning competence for administrative violations specified in Chapter III of Decree 96/2020 is the sanctioning competence for individuals.
In the case of fines in Vietnam, the sanctioning competence of the organization is twice that of the individual.
Decree 37/2022/ND-CP takes effect from July 22, 2022.
