Regarding this issue, LawNet would like to answer as follows:

1. Conditions and time for enjoying the allowance for management responsibilities of the reserve force unit in Vietnam

* Conditions for receiving allowances

The subjects specified in Section 2, who perform the responsibility of managing the reserve force unit and have 45 full days in a quarter or more, shall be entitled to allowances for that quarter.

In a quarter, reserve soldiers who are appointed to a new position will be entitled to a responsibility allowance according to the new position for the next quarter.

In addition, the beneficiaries of allowances specified in Section 2 shall stop enjoying allowances specified in Clause 1, Article 3 of Decree 79/2020/ND-CP.

* Allowance period

The period of allowance for the subjects specified in Section 2 is the period during which a reserve soldier is appointed to hold the position of commander of a reserve unit.

2. The latest level of allowance for management responsibilities of the reserve force unit in Vietnam

Specifically, in Clause 2, Article 3 of Decree 79/2020/ND-CP, reserve soldiers appointed to hold the position of commander of a reserve unit at the squad level and equivalent or higher are entitled to the following allowances: :

- The level of 480,000 VND/quarter for Platoon Leaders, Battalion Captains and equivalent.

- Level 560,000/quarter for Platoon Leader and equivalent.

- The level of 640,000 VND/quarter for the Deputy Captain, Political Officer of the Company and the equivalent.

- The level of 720,000 VND/quarter for company captains, company politicians and equivalent.

- The level of 800,000 VND/quarter for Deputy Battalion Commander, Deputy Battalion Politician and equivalent.

- Level 880,000 VND/quarter for Battalion Commander, Battalion Politician and equivalent.

- Level 960,000/quarter for Regiment Deputy Commander, Regiment Deputy Political Commissar and equivalent.

- Level 1,040,000 VND/quarter for Regiment Commander, Regiment Political Commissar and equivalent.

3. What is a reserve force unit?

According to Clause 4, Article 2 of the Law on Military Reserve Forces 2019, reserve force unit refers to a military organization that is mainly or entirely composed of reserve servicemen and technical equipment listed in the plan for provision of additional manpower for standing bodies of People’s Army; that is organized and staffed in an incomplete manner or has not yet been organized in peacetime, but has the plan for conscription of members of reserve forces or provision of additional manpower for armed forces in wartime under order for conscription of reservists.

4. Principles of building and mobilizing reserve forces in Vietnam

The construction and mobilization of the mobilization reserve force are carried out based on the principles specified in Article 3 of the Law on Military Reserve Forces 2019, specifically as follows:

- Comply with the Constitution and laws of the Socialist Republic of Vietnam; placed under the absolute, direct leadership in all aspects of the Communist Party of Vietnam, the domination of the President, the centralized and unified management of the government, and the command and direction of the Minister of Defense.

- Build a reserve force that is strong politically, ideologically, and organizationally, has a high combat level, and is strictly managed.

- Mobilize the synergy of the entire people.

- Closely combine socio-economic development with strengthening national defense and security; in line with the socio-economic development situation of the country.

- Build and mobilize reserve force units to ensure sufficient reserve troops and technical means; right standards, time; ensure confidentiality and safety as prescribed by law and approved plans.

- Apply scientific, technical and technological achievements in construction, mobilizing reserve and mobilization forces.
